Consideration of a Resolution approving a Minor Subdivision of 256 Cleveland <br />Avenue SW creating one new lot for development of an 11,200 SF office building <br />Motion by Councilmember Jacobsen, seconded by Councilmember Bauman to open the <br />Public Hearing. <br />5 Ayes, 0 Nays - Motion Carried <br />The Public Hearing was opened at 7:02 p.m. <br />Motion by Councilmember Strub, seconded by Councilmember Burg to Adopt a Resolution <br />approving a Minor Subdivision of 256 Cleveland Avenue SW creating one new lot for <br />development of an 11,200 SF office building subject to four conditions. <br />City Manager Lotter indicated Assistant Director of Community Assets and Development/Planning Director <br />Gundlach would be presenting this item to the Council. <br />Assistant Director of Community Assets and Development/Planning Director Gundlach explained the <br />applicant is requesting a Minor Subdivision for 256 Cleveland Avenue SW, subdividing off the <br />southern 93' of the existing 330' lot. The existing property is 1.5 acres or 64,099 SF in land <br />area (minus the Cleveland Avenue roadway easement). The newly subdivided lot (Proposed <br />Parcel A) would be 45,163 SF in land area or 1.04 acres. The remaining lot (Proposed Parcel <br />B) would be 93' wide and 18,936 SF in land area or 0.43 acres. The existing single-family <br />home would remain on Proposed Parcel B; however, the accessory structures would be brought <br />into compliance with the requirements of Section 4-530. This includes moving the barn off the <br />rear property line to a 5' setback and elimination of one of the detached garages. Post <br />subdivision, both lots will be in compliance with minimum lot area and lot width requirements <br />for the R-1, Single Family Residential zoning district. Should the Council approve the <br />Rezoning, no minimum lot area or width requirements exist for the B-1, Limited Business <br />zoning district. <br />Assistant Director of Community Assets and Development/Planning Director Gundlach reported the <br />applicant has made application for a Rezoning, Comprehensive Plan Amendment, and Site <br />Plan for development of the northerly one acre property with a commercial office use, which is <br />being considered by Council separately. However, the requests are conditioned on all four <br />applications being approved whereby the lot wouldn't be approved for subdivision without <br />approval of the Rezoning, Comprehensive Plan Amendment, and Site Plan. <br />Assistant Director of Community Assets and Development/Planning Director Gundlach explained there are <br />various development fees that will be due at the time a building permit is requested for <br />development of Proposed Parcel A. These fees include, but are not limited to, a Sewer Access <br />Charge through the Metropolitan Council and park dedication. City Code Section 26-18 <br />outlines which projects are eligible for Minor Subdivision approval verses a Preliminary and <br />Final Plat. Because this subdivision is of small size and conditions are well defined, only a <br />Minor Subdivision is necessary. As stated in Section 26-18 (1) the City Council shall hold the <br />public hearing after proper published and mailed notice to property owners within 350'. She <br />reported proper published and hailed notice has been given. Staff indicated as of the drafting <br />of this memo, several objections have been voiced at the Planning Commission's June 20" <br />public hearing.
