<br />,> <br /> <br />RESOLUTION No. 96-044 <br /> <br />STATE OF MINNESOTA <br />COllNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />I RESOLUTION APPROVING JURISDICTIONAL CHANGE OF 8TH A VENUE NW BETWEEN OLD HIGHWAY 8 <br />~I AND IOTHSTREETNW. <br /> <br />WHEREAS, the 1991 Minnesota Legislature established a Ramsey County Local Government <br />Services Study Commission to "report on the advantages and disadvantages of sharing, cooperating, <br />restructuring, or consolidating..." activities in areas of public service including public works; and <br /> <br />": <br /> <br />WHEREAS, the consolidation plan provides for reclassification of roadways and corresponding <br />.' changes in jurisdiction including the transfer of local and State Aid roadways between the County <br />I and municipalities; and <br />:,' <br /> <br />WHEREAS, 8th Avenue NW (County State Aid Highway 45) from Old Highway 8 to 10th Street <br />:! NW, located in the City of New Brighton, is presently under the jurisdiction of Ramsey County as a <br />County State Aid Highway; and <br /> <br />WHEREAS, this roadway segment has been determined to serve a local function only; and <br /> <br />WHEREAS, revocation of "County State Aid Highway" status may be accomplished by <br />resolution ofthe Ramsey County Board of Commissioners pursuant to Minnesota State Statutes <br />" ~162.02; and <br /> <br />WHEREAS, the City of New Brighton has concurred that jurisdiction should be changed from <br />Ramsey County to the City of New Brighton; and <br /> <br />WHEREAS, the consolidation plan stipulates that Ramsey County shall improve the roadways to <br />acceptable levels prior to transferring jurisdiction over roadway segments from Ramsey County to <br />municipalities, and the Ramsey County Capital Improvement Program provides funding for these <br />improvements; and <br /> <br />WHEREAS, the City of New Brighton desires to reconstruct this segment of Eight Avenue NW <br />for an estimated cost of $340,000 and fund the construction project with Municipal State Aid Street <br />sources, and an estimated $60,000 from Capital Improvement funds for Ramsey County Roadway <br />Consolidation; <br /> <br />Now, THEREFORE BE IT RESOLVED, that the revocation of 8th Avenue NW will be effective the <br />date of the award of the reconstruction contract, and after the Ramsey County Office of Budgeting & <br />Accounting has encumbered the funds necessary to reimburse the City and the County is in receipt of <br />an adopted resolution from the City concurring with the County revoking the "County State Aid <br />Highway" status of 8th Avenue NW; and <br /> <br />BE IT FURTHER RESOLVED, that the County will pay to the City as just compensation for this <br />jurisdiction transfer, an estimated $60,000 (the total compensation is calculated from the "County <br />Road" Reconstruction Cost Participation Policy, Resolution 9-1272, and adjusted by Pavement <br />Management System {(90-Condition Rating} * 1993 Condition Rating) upon presentation of billings <br />from the construction contractor for reconstruction of this segment of 8th Avenue NW; and <br />
