<br />1. <br /> <br />"" <br /> <br />RESOLUTION No. 96 -041 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING SP-192. <br /> <br />WHEREAS, an application for a special use permit has been made by Innsbruck Partnership Inc. <br />To allow for the construction of and entryway, canopy and parking area on an existing nursing home <br />building and site. <br /> <br />WHEREAS, an application for a variance has been made by Innsbruck Partnership, Inc. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for a special use permit was filed with the City of New Brighton on May <br />31, 1996. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on June 18, 1996, and all persons present at the hearing were given an <br />opportunity to be heard. <br />3. The City Council considered SP-l92 at its meeting on June 25, 1996. <br /> <br />NOW, THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in <br />respectto SP-192. <br />l. The subject property is zoned R-3B, Multiple Family Residential. <br />2. A nursing home is a special use in the R-3B District. <br />3. Innsbruck Partnership Inc. Is an existing nursing home proposing to construct an <br />entryway, canopy and parking area. <br />4. Any alteration to an existing special use requires the issuance of a special use permit. <br />5. The proposed expansion would not increase the number of residents at the nursing home <br />or the square footage of the building. <br />6. The proposed entryway and canopy would allow for ambulances to pick up and drop off <br />residents at the lower level ofthe nursing home building. Currently, there are no <br />entryways to the lower level of the nursing home that are vehicle accessible. <br />7. The limited number of off street parking stalls proposed as part of Phase One of the <br />purposed entryway project, and the City Engineer's favorable review of the proposed <br />curb cut(s) on the Black Oak Drive curve, would indicate the proposed project would <br />have a minimal impact on surrounding land uses. <br />8. The establishment, maintenance or operations of the special use will not be detrimental <br />to or endanger the public health, safety, morals, or comfort of the general public. <br />9. The special use will not be injurious to the use and enjoyment of other property in the <br />immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />10. The establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />11. Adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided, <br />12. The special use shall in all other respects, conform to the applicable regulations of the <br />district in which it is located. <br /> <br />Page I of2 <br />
