<br />II <br />! <br /> <br />I; <br />" <br />ii <br /> <br />i: <br />" <br /> <br />RESOLUTION No. 96-041A <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKINO FINDINGS OF FACT AND APPROVING VN-305. <br /> <br />~ : <br /> <br />WHEREAS, an application for a variance has been made by Innsbruck Partnership, Inc. <br /> <br /> <br />WHEREAS, the procedural history ofthe application is as follows: <br />1. An application for a variance was filed with the City of New Brighton on May 31, 1996. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on June 18, 1996, and all persons present at the hearing were given an <br />opportunity to be heard. <br />3. The City Council considered VN-305 at its meeting on June 25, 1996. <br /> <br />" <br />I. ~ <br />;1 <br /> <br />NOw, THEREFORE BE IT RESOLVED, the Planning Commission makes the following Findings of <br />Fact in respect to VN-305: <br /> <br /> <br /> l. <br /> 2. <br /> 3. <br /> 4. <br />'i <br />" 5. <br /> <br />The subject property is zoned R-3B, Multiple Family Residential. <br />The required street side yard setback in the R-3B district is 30 feet. <br />The proposed driveway (Phase One parking area) would be located 21 feet from the <br />Black Oak Drive right-of-way line. <br />A nine-foot street side yard setback would need to be approved to construct the driveway <br />(Phase One parking area) as proposed. <br />The unique circumstance in this case is the severe slopes located on the subject site. Due <br />to the severe slopes on the north and south sides of the nursing home site, the west <br />portion of the site is the only side which lends itself to an entry way to the lower level of <br />the building. The west side ofthe site has a limited buildable area. The required 30 foot <br />street side yard setback further restricts that buildable area. Strict enforcement ofthe 30 <br />foot setback requirement, in this case, would cause the applicant an undue hardship. <br />6. The applicant has demonstrated unique and unusual circumstances and an undue <br />hardship pertaining to the variance request. <br /> <br />BE IT FURTHER RESOLVED, the application VN-30S is hereby approved, subject to the following <br />condition: <br /> <br />i.; <br /> <br />l. <br /> <br />Approval of and continuing compliance with LP-312 and VN-305. <br /> <br /> <br />~~ ~- 0~ <br />;", .
