<br />EXHIBIT C R SPECIFIC FINDINGS FOR SUBDISTRICT <br /> <br /> <br />. ion to the findings included in Exhibit A, the reasons and facts supporting the <br />al findings for the Subdistrict Plan for the Subdistrict pursuant to Minnesota <br />, Section 469.175, Subdivisions 3 and 7, are as follows: <br /> <br />inding that the Subdistrict is a "hazardous substance subdistrict" as <br />in Minnesota Statutes. <br /> <br />he Subdistrict consists of seven parcels, located within the Modified District <br />re designated as a hazardous substance site as defined in Minnesota Statutes, <br />Secti 469.174, Subdivision 16 and are included in a development action response plan <br />("RAP' as required by Minnesota Statutes, Section 469.174, Subdivision 16. The RAP <br />entitle "Phase II Summary Report and Response Action Plan, Planned Residential <br />Rede lopment, Western Portion of the Northwest Quadrant, New Brighton, Minnesota" <br />was pared by Barr Engineering and dated April 2005. The Council will certify to the <br />Coun Auditor that it has entered into an agreement(s) providing for the removal or <br />reme i I actions as specified in its RAP. The City has received from the Minnesota <br />Pollut n Control Agency a Conditional Response Action Plan Approval Letter dated June <br />30, 2 5 and an Approval of Voluntary Response Actions for Petroleum Contamination <br />dated ctober 20,2005. <br /> <br />City staff has reviewed the estimated costs of the necessary removal and/or <br />I actions and the available methods of financing these activities. Although some <br />ax increment generated from the Modified District will assist with the remediation <br />and r oval efforts, additional assistance is required for these extensive costs. Without <br />the a ditional tax increment generated by the Subdistrict, the redevelopment of the <br />Modi d District is economically unfeasible and cannot proceed. In summary, the <br />prop ed redevelopment can not occur without the remediation described in the RAP, <br />and t revenues generated by the Modified District are not sufficient to pay for the <br />reme ation costs. <br /> <br /> <br />inding that the proposed development within the Subdistrict, in the opinion <br />Council, would not occur solely through private investment within the <br />ably foreseeable future and, therefore, the use of tax increment financing is <br />d necessary. <br /> <br />he activities expected to occur within the Subdistrict include the removal and/or <br />I actions necessary to be undertaken and completed in order to facilitate the <br />ction of the housing units and office space as described in Item 2 of Exhibit B. <br /> <br />3.
