Procedurally, the alleyway Vacation would be <br />recorded at the County first, returning the rightful amount of alley to the property at 327 2nd <br />Avenue SE. The proposed subdivision would create a new property line centrally within the <br />vacated alleyway. By returning 10’ of alley to the lots fronting on 2nd Avenue SE and 3rd <br />Avenue SE, the applicant has enough land area to meet the minimum lot size area of 10,000 <br />SF. The existing and proposed lot area dimensions were discussed. There are various <br />development fees that will be due at the time a building permit is requested for construction of <br />a new house on the proposed new lot off 3rd Avenue SE. These fees include, but are not <br />limited to, a Sewer Access Charge through the Metropolitan Council ($2,485) and a park <br />dedication fee ($1,754). <br /> <br />Assistant Director of Community Assets & Development/Planning Director Gundlach stated City Code <br />Section 26-18 outlines which projects are eligible for Minor Subdivision approval verses a <br />Preliminary and Final Plat. Because this subdivision is of small size and conditions are well <br />defined, only a Minor Subdivision is necessary. As stated in Section 26-18 (1) the City Council <br />shall hold the public hearing after proper published and mailed notice to property owners <br />within 350’. Proper published and mailed notice has been given. As of the drafting of this <br />memo, two inquiries have been received and there are no known objections.
