December 13, 2016 Page 6 of 11
for development of a single-family home. Procedurally, the alleyway Vacation would be
recorded at the County first, returning the rightful amount of alley to the property at 327 2nd
Avenue SE. The proposed subdivision would create a new property line centrally within the
vacated alleyway. By returning 10’ of alley to the lots fronting on 2nd Avenue SE and 3rd
Avenue SE, the applicant has enough land area to meet the minimum lot size area of 10,000
SF. The existing and proposed lot area dimensions were discussed. There are various
development fees that will be due at the time a building permit is requested for construction of
a new house on the proposed new lot off 3rd Avenue SE. These fees include, but are not
limited to, a Sewer Access Charge through the Metropolitan Council ($2,485) and a park
dedication fee ($1,754).

Assistant Director of Community Assets & Development/Planning Director Gundlach stated City Code
Section 26-18 outlines which projects are eligible for Minor Subdivision approval verses a
Preliminary and Final Plat. Because this subdivision is of small size and conditions are well
defined, only a Minor Subdivision is necessary. As stated in Section 26-18 (1) the City Council
shall hold the public hearing after proper published and mailed notice to property owners
within 350’. Proper published and mailed notice has been given. As of the drafting of this
memo, two inquiries have been received and there are no known objections. Staff
recommended the Council hold a public hearing, take public testimony and adopt the
Resolutions.

Motion by Councilmember Bauman, seconded by Councilmember Jacobsen to open the
Public Hearing.

5 Ayes, 0 Nays - Motion Carried

The Public Hearing was opened at 7:43 p.m.

Mayor Johnson asked for additional comments, there were none.

Motion by Councilmember Bauman, seconded by Councilmember Jacobsen to close the
Public Hearing.

5 Ayes, 0 Nays - Motion Carried

The Public Hearing was closed at 7:44 p.m.

Councilmember Jacobsen asked if the entire alleyway would be vacated.
