Letter of Agreement (LOA-106) 03/2017 Page 2 <br />The Minnesota Department of Public Safety, Division of Homeland Security and Emergency <br />Management (hereinafter identified as "HSEM") and the City of New Brighton, Department of Public <br />Safety (hereinafter identified as "New Brighton") enter into the following agreement for the temporary <br />use of the meeting space and Emergency Operations Center (EOC) in the New Brighton Public Safety <br />building in the event of an emergency/disaster that renders all or part of HSEM's central office space <br />(including the State Emergency Operations Center (SEOC) unusable. <br />I. PURPOSE <br />The purpose of this letter of agreement is to delineate the conditions that have been mutually <br />agreed upon by New Brighton and HSEM whereby the New Brighton Public Safety building, and <br />other city-owned auxiliary buildings as may be required, will be made available on a temporary <br />basis to HSEM in the event that a disaster or emergency results in the inability to utilize all or <br />parts of the HSEM central office. <br />II. BACKGROUND <br />HSEM is responsible for providing a number of services to state agencies, to local government, to <br />business and industry, and to citizens. Many of these services are of an emergency or time- <br />sensitive nature. Consequently, HSEM must be able to continue to provide them even if its central <br />office is severely damaged or destroyed by a disaster, or is otherwise made unusable. <br />III. AGREEMENTS <br />A. HSEM agrees to: <br />1. Provide as much advance notification as possible of the need to temporarily relocate <br />the State EOC, portions of its central office, or its entire central office. <br />B. New Brighton agrees to: <br />1. Make as much space in the Public Safety building located at 785 Old Highway 8 <br />Northwest, New Brighton available to HSEM, on a temporary basis, including <br />intra/internet capabilities as needed. <br />2. Make space in the City Hall building at 803 Old Highway 8 Northwest, New Brighton, <br />available to HSEM, on a temporary basis, to be used as the Joint Information Center <br />(JIC) and Media Briefing Room. <br />3. Make any city-owned auxiliary building available to HSEM, on a temporary basis and <br />as designated, to be used for additional HSEM duties as assigned. <br />IV. AGREEMENT AND MODIFICATION OF AGREEMENT <br />This letter of agreement and any modifications thereto represent the entire agreement between the <br />parties and supersede all prior oral and written statements or agreements. Modifications of this <br />agreement must be in writing and approved by all parties to this agreement. <br />V. LIABILITY <br />Each party to this agreement is responsible for its own acts and omissions under this agreement.
