I:\Council - NEW FOLDER\2017\Report Drafts and Working Documents\Community Dev and Assets\Planning & Economic <br />Development\2017.04.25\Seminary SUP\PSR17-0001 (Seminary) - RESOLUTION.doc 1 <br /> <br />RESOLUTION NO. <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT FOR 3000 5TH ST <br />NW. <br /> <br />WHEREAS, an application has been made by United Theological Seminary to permit operation of a <br />300 student, kindergarten thru eighth grade school, utilizing existing buildings, for property <br />located at 3000 5th Street NW, and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for a Special Use Permit was received on February 24, 2017. <br />2. A public hearing notice was published in the March 8, 2017 edition of the New Brighton <br />Bulletin. <br />3. Public hearing notices were mailed to property owners within 350’ of the applicant’s <br />property on March 10, 2017. <br />4. On March 15, 2017 the applicant submitted a written request to table action on their request <br />to the April 18, 2017 Planning Commission meeting. <br />5. The applicant held a neighborhood meeting on April 5, 2017. <br />6. Public hearing notices were mailed to property owners within 350’ of the applicant’s <br />property on April 7, 2017. <br />7. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on April 18, 2017 and all present were given a chance to freely speak at the hearing. <br />8. The Planning Commission voted to recommend conditional approval on April 18, 2017. <br />9. The City Council considered the request on April 25, 2017. <br /> <br />WHEREAS, the Planning Commission and City Council make the following Findings of Fact with <br />respect to the Special Use Permit (PSR17-0001): <br />1. The property is zoned R – 1, Single Family Residential. <br />2. The property is guided in the Comprehensive Plan for P-QP, Public-Quasi Public. <br />3. The property is currently being used as a theological seminary campus. <br />4. The applicant is proposing to add a 300 student, K-8 school to the property, including the <br />addition of an outdoor play area, utilizing the existing McMillan Center and Spencer Library <br />buildings. <br />5. Zoning Code Section 4-030(1) requires a special use permit for schools to operate in the R – <br />1, Single Family Residential district. <br />6. The seminary is operating under a Special Use Permit dating back to 1961 that limits use to a <br />theological seminary. <br />7. The Planning Commission and City Council reviewed the proposal in accordance with the <br />following Special Use Permit conditions of Zoning Code Section 8-130: <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare.
