<br /> <br /> <br />REQUEST FOR CITY COUNCIL CONSIDERATION <br /> <br />ITEM DESCRIPTION: Consider Repealing Chapter 29, Article 4, Sections 29-58 through <br />29-63 Regarding Bicycles from the City Code <br /> <br /> <br />DEPARTMENT HEAD’S APPROVAL: Jason Hicks, Acting Director of Parks and <br />Recreation <br /> <br />CITY MANAGER APPROVAL: <br /> <br /> <br />No comments to supplement this report _______ Comments attached ______ <br /> <br />Recommendation: <br />Staff recommends Council repeal Chapter 29, Article 4, Sections 29-58 through 29-63 regarding bicycles <br />form the City Code <br /> <br />Explanation: <br />The Parks, Recreation and Environmental Commission (PREC) passed a motion to review the elements <br />of Chapter 29, Article 4 and bring the City Code and policies on bicycles up to date with state standards <br />at the March 1, 2017 PREC meeting. <br /> <br />In reviewing the City Code, it was determined the entire Article could be repealed from the City Code. <br />There are sections of the code that do not comply with State Statute and others, that while more stringent <br />that State Statute, are difficult to enforce. <br /> <br />Section 29-58 currently adopts Minnesota State Statute Section 169.222. This statute applies in New <br />Brighton whether it is adopted by City Ordinance or not. <br /> <br />Section 29-59 addresses equipment and equipment provisions that are covered in Minnesota State Statute <br />Section 169.222. <br /> <br />Section 29-60 makes it unlawful to use a bicycle without the owner’s permission. This is covered in <br />State Statute that address theft. <br /> <br />Section 29-61 makes it unlawful for a parent to authorize or knowingly allow their child to violate the <br />City’s bicycle ordinance. This is recommended for repeal because of the difficulty to enforce. <br /> <br />Section 29-62 references suspension and revocation of bicycle licenses. This is recommended for repeal <br />because bicycle licenses can no longer be obtained. <br /> <br />Section 29-63 currently imposes stricter regulations than State Statute. It prohibits bikers from biking <br />past pedestrians on sidewalks, it requires bikers to dismount from their bikes and pass pedestrians on <br />foot.
