<br /> <br /> <br />REQUEST FOR CITY COUNCIL CONSIDERATION <br /> <br />ITEM DESCRIPTION: Consideration of Ordinance 852 Amending Article 4 of Chapter 8 of <br />the Zoning Code Concerning Expansion of a Nonconforming Use. <br />DEPARTMENT HEAD’S APPROVAL: Craig Schlichting, Director of Community Assets & <br />Development <br /> <br />CITY MANAGER APPROVAL: <br /> <br /> <br />No comments to supplement this report _______ Comments attached ______ <br /> <br />15.99 Deadline: Not applicable <br /> <br />Recommendation: Adopt Ordinance 852. <br /> <br />Legislative History: June 20, 2017: The Planning Commission considered the request and held <br />a public hearing. No persons provided testimony. The Commission asked a few clarifying <br />questions to reaffirm the intent of the proposed ordinance. Staff reiterated Ordinance No. 852 is <br />intended to more clearly codify an existing interpretation of what constitutes an expansion. <br /> <br />Financial Impact: None <br /> <br />Explanation: City staff is initiating an amendment to the City’s Zoning Code, Article 4 of <br />Chapter 8, concerning nonconforming uses. The proposed amendment aims to clarify an <br />existing interpretation that nonconforming uses cannot be expanded. While the current language <br />of Article 4, Chapter 8 is clear that nonconforming uses, buildings and structures cannot be <br />expanded, the proposed amendment aims to more clearly articulate what is included in a use <br />expansion. <br /> <br />Proposed Ordinance No. 852 includes a definition of “expansion” or “expanded” when <br />referenced numerous times throughout the entire article. The definition is the most significant <br />impact of the proposed amendment. The rest of the Article remains unchanged. <br /> <br />The reason for this amendment arose out of a request for a Zoning Compliance letter for a legal, <br />nonconforming trucking operation at 50 14th ST NW. This property recently changed ownership <br />and the City wanted to clarify what is permitted of a nonconforming use. The drafting of this <br />amendment was communicated to the entity who requested the Zoning Compliance letter.
