<br /> <br /> <br />REQUEST FOR CITY COUNCIL CONSIDERATION <br /> <br />ITEM DESCRIPTION: Consider Ordinance No. 853 and a Resolution Amending Chapter 32 <br />(Public Right-of-Way) of the New Brighton City Code to include Right-of-Way Amendments for <br />Small Wireless Facilities and allowing for a summary publication. <br />DEPARTMENT HEAD’S APPROVAL: Craig Schlichting, Director of Community Assets & <br />Development <br />CITY MANAGER APPROVAL: <br /> <br /> <br />No comments to supplement this report ___ ___ Comments attached ______ <br /> <br />Recommendation: Adopt Ordinance No. 853 Amending Chapter 32 of New Brighton City <br />Code to include Small Wireless Facilities. <br /> <br />Adopt the Resolution provided, allowing for a summary publication of the ordinance <br />amendment. <br /> <br />Legislative History: The State Legislature recently made changes during their last session in <br />July that gives telecommunications/small wireless facilities the right to install facilities in the <br />right-of-way and use the right-of-way for the delivery of those services. Use of right-of-way may <br />be denied if necessary to protect public health, safety, or welfare. <br /> <br />Explanation: The 2017 Session Law amendments were the product of negotiations between <br />wireless and cable industry representatives and representatives of municipalities. Because of the <br />state’s statutory changes, the City of New Brighton needs to make changes to Chapter 32: Public <br />Right-of-Way.
