<br /> <br /> <br />REQUEST FOR CITY COUNCIL CONSIDERATION <br /> <br />ITEM DESCRIPTION: Consideration of a Resolution extending the effective date of a <br />Special Use Permit for 3000 5th ST NW. <br />DEPARTMENT HEAD’S APPROVAL: Craig Schlichting, Director of Community Assets <br />& Development <br /> <br />CITY MANAGER APPROVAL: <br /> <br /> <br />No comments to supplement this report _______ Comments attached ______ <br /> <br />15.99 Deadline: Not applicable <br /> <br />Recommendation: Adopt the Resolution provided, granting a 180-day extension to the Special <br />Use Permit granted via Resolution 2017-025. <br /> <br />Legislative History: April 25, 2017: The City Council considered the Special Use Permit and <br />adopted Resolution 2017-025, approving the request subject to nine conditions. The request was <br />approved 4-1, with Council member Bauman dissenting. <br /> <br />April 18, 2017: The Planning Commission considered the request and held a public hearing. At <br />least ten different residents provided testimony. After a robust conversation surrounding hours of <br />operation, the playground location, traffic, and public safety concerns, the Commission voted 5-1 <br />to approve the request subject to the 12 conditions recommended by staff, including revisions to <br />conditions 1, 5, 9, and 12. Commissioner Danger dissented, indicating his unwillingness to support <br />the request due to the school tenant being unknown at this time. <br /> <br />Financial Impact: None <br /> <br />Explanation: The New Brighton Zoning Code, Section 8-250, states that special use permits, <br />when not used, shall expire after 180 days after the date of the issuance unless written application <br />for renewal or time extension is received and granted by the City Council prior to the expiration <br />date. The United Theological Seminary was granted a Special Use Permit for a 300 student, K-8 <br />school on April 25, 2017 via Resolution 2017-025. This request has not been acted on and is slated <br />to expire on October 22, 2017. The applicant submitted a letter requesting to extend the approval <br />for an additional six months on October 3, 2017. The letter indicates the seminary “continues to <br />market space within its campus for a school” and that they “hope to be able to make an <br />announcement soon”.
