1 <br />RESOLUTION NO. 17-____ <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION EXTENDING THE EFFECTIVE DATE FOR A SPECIAL USE PERMIT APPROVED VIA <br />RESOLUTION 2017-025, ALLOWING FOR A 300 STUDENT, K-8 SCHOOL AT 3000 5TH ST NW. <br />WHEREAS, a request has been made by the United Theological Seminary to extend a Special Use <br />Permit previously approved allowing for implementation of a 300 student, K-8 school at the <br />existing United Theological Seminary Campus at 3000 5th ST NW approved on April 25, 2017, <br />and <br />WHEREAS, the procedural history of the application is as follows: <br />1.The Planning Commission recommended approval of the Special Use Permit on April 18, <br />2017. <br />2. Subsequently, the City Council approved the Special Use Permit request on April 25, 2017. <br />3.Resolution 2017-025 was adopted by the City Council on April 25, 2017 outlining nine <br />conditions of approval for the Special Use Permit. <br />4.The City of New Brighton Zoning Code, Section 8-250, states that special use permits, when <br />not used, shall expire after 180 days after the date of issuance unless written application for <br />renewal or time extension is received and granted by the City Council prior to the expiration <br />date. <br />5.180 days will have elapsed on October 22, 2017 and the applicant has indicated they will not <br />have acted on the Special Use Permit by that date. <br />6.The applicant submitted to City staff written request for the extension on October 3, 2017. <br />7. The City Council considered the extension request on October 10, 2017. <br />NOW THEREFORE BE IT RESOLVED, per Zoning Code Section 8-250 the effective date of the <br />Special Use Permit granted via Resolution 2017-025 is hereby extended an additional 180 days <br />to April 20, 2018, subject to the following condition: <br />1.
