Memo <br />To: Dean Lotter, City Manager <br />From: Terri Spangrud, City Clerk <br />Subject: Municipal Elections – Odd-numbered Years vs Even-Numbered Years <br />Date: July 20, 2017 <br />Issue: <br />How does newly amended Minnesota State Statutes, section 205.07, subdivisions 1 and 3 impact the <br />City of New Brighton’s ability to change the year of municipal elections, should the City Council wish to <br />pursue this again? <br />Background: <br />In the 2017 legislative session, a bill was passed amending Minnesota State Statutes, section 205.07. <br />These statutes now clarify the deadline of election for moving election years, tying it to the election and <br />candidate filing instead of the calendar year. <br />Subdivision 1 now reads: <br />Date of election. <br />The municipal general election in each city shall be held on the first Tuesday after the first <br />Monday in November in every even‐numbered year. Notwithstanding any provision of law to <br />the contrary and subject to the provisions of this section, the governing body of a city may, by <br />ordinance passed at a regular meeting held before June 1 of any year, elect to at least 180 <br />calendar days before the first day to file for candidacy in the next municipal election, decide <br />to hold the election on the first Tuesday after the first Monday in November in each either an <br />even‐ or odd‐numbered year. <br />Subdivision 3 now reads: <br />Effect of ordinance; referendum. <br />An ordinance changing the year of the municipal election is effective 240 days after passage and <br />publication or at a later date fixed in the ordinance.
