Chairperson Nichol s -M atkaiti questioned if some sort of eviction process would be created through the new <br />Ordinance. Gundlach discussed the proposed removal agreement in further detail with the Commission. <br />Commissioner Danger explained that some units may not be able to be removed in the winter months if placed <br />in a rear yard. He asked how staff came up with the $1,500 financial surety amount. He feared that the <br />proposed amount could be burdensome for some families. Gundlach stated this number was enough that <br />residents would want to receive the funds back but was not too much to be a burden. She reported that it was <br />more important for the City to gain compliance on this issue than to receive the money. <br />Commissioner Deick anticipated that $1,500 was about the monthly rent for one of these units. He supported <br />the proposed surety amount. <br />The Commission discussed the temporary health care unit removal process further. <br />Commissioner Danger questioned what type of grace period would be offered if the removal timeframe was <br />violated. Gundlach indicated every situation will be unique but anticipated the City would offer the applicant a <br />30 -day grace period to bring the property into compliance. <br />Commissioner Frischman did not want to see the City overregulating this issue given the fact the families <br />dealing with a temporary health care unit were in already dealing with a difficult situation. Gundlach reiterated <br />that it would be more important for the City to gain compliance and the units removed in a timely manner than <br />to be forced to remove the unit. <br />Commissioner Deick stated the City risked looking like the "bad guy" in this situation if a confrontation is <br />required in order to get a unit removed if an individual was still within the unit. He believed the City was <br />walking a thin line with regard to the removal agreement. He suggested the removal process be pushed back to <br />the vendor and not be a City requirement. She reported the City would use a reasonable standard when <br />removing a unit. <br />Commissioner Deick questioned how the City would monitor unit removal. Gundlach discussed how the City <br />would monitor the removal process. She understood the Commission had concerns with the removal process <br />and suggested the Public Hearing be postponed to allow for further discussion of this matter at the March <br />Planning Commission meeting. <br />Commissioner Danger suggested the language regarding the number of occupants within a temporary health <br />care unit be addressed. Councilmember Strub agreed this issue needed to be written into the Ordinance. The <br />Commission supported this recommendation. <br />Commissioner Deick asked if the renewal fee would be less than the original application. Gundlach reported <br />this would be the case. <br />Commissioner Danger inquired if any other Commission members had concerns with the $1,500 financial <br />guarantee rate. Commissioner Miwa stated she struggled with this amount a little bit. Councilmember Strub <br />suggested the financial guarantee be set at $1,000 with the understanding the rate could always be increased if <br />the City were to find this was an issue. She discussed the expense the City would incur to impound a health <br />care dwelling unit. <br />
