A commissioner asked if the seminary would review the potential tenants keeping in mind what would be best <br />for the surrounding neighborhood. Mr. Beck stated he would want what would be compatible with the <br />seminary property and the surrounding neighborhood. <br />Motion by Commissioner Frischman, seconded by Commissioner Fynewever to close the Public Hearing. <br />Approved 6-0. <br />Motion by Commissioner Frischman, seconded by Commissioner Jones, to approve the staff <br />recommendation with amendments to Conditions #1, #5, #9 and #12. <br />Approved 5-1 (Danger opposed). <br />Motion by Commissioner Danger, seconded by Commissioner Fynewever to recess the meeting at 9:48 <br />p.m. <br />Approved 6-0. <br />Motion by Commissioner Frischman, seconded by Commissioner Murphy to reconvene the meeting at <br />9:53 p.m. <br />Approved 6-0. <br />(B) City of New Brighton requests consideration of Ordinance No. 850 creating a new Article 18 to <br />Chapter 15 of the City Code creating a Temporary Family Health Care Dwelling License. <br />Planning Director Janice Gundlach commented the City of New Brighton is initiating consideration of a City Code <br />Amendment creating a new Article 18 to Chapter 15, establishing a license and imposing restrictions on the use of <br />Temporary Family Health Care Dwellings. The purpose of the amendment is to require a license for the use of <br />Temporary Family Health Care Dwellings and to impose restrictions that go beyond those found in Minnesota <br />Statues, Section 462.3593. <br />Planning Director Gundlach explained while not part of the Zoning Code, the proposed City Code amendment is <br />being presented to the Planning Commission for a public hearing as the allowances under the ordinance, and <br />restrictions, have zoning implications for New Brighton. <br />Planning Director Gundlach stated this item was a directive of the City Council as part of their adoption of <br />Ordinance No. 845, which opted out of Minnesota Statues, Section 462.3593. The direction of the City Council was <br />to create a local tool that allows use of Temporary Family Health Care Dwellings, yet addresses concerns and gaps <br />in regulation that are found in Minnesota Statues, Section 462.3593. <br />Planning Director Gundlach reported lastly, the Planning Commission discussed the matter in during five work <br />sessions/meetings held on September 20, 2016, October 18, 2016, January 17, 2017, February 21, 2017, and March <br />21, 2017.
