FINDINGS <br />Section 4-030. Special Permit Uses in an R-1 District. <br />Section 8-130. Special Use Standards. <br /> <br />SITE CHARACTERISTICS <br />Location: 3000 5th Street NW <br />Lot Size: 10.63 Acres (463,043 SF) <br />Topography: Varies <br />Comprehensive Plan Designation: P-QP, Public & Quasi Public <br />Zoning: R – 1, Single Family Residential <br />Surrounding Land Uses: <br /> North: Seminary Drive - single family homes <br /> South: 5th ST NW – MPLS waterworks & NB water treatment <br />plant #1 <br /> East: single family homes <br /> West: Stinson Boulevard – single family homes (Col. Hgts.) <br /> <br />SPECIAL USE PERMIT ANALYSIS <br />The proposed Special Use Permit is to allow use of existing buildings, at an already developed <br />property, to be used for a 300 student K-8 grade school. The following special use criteria shall <br />be considered (staff responses in italics): <br /> <br />Sec. 4-030. Special Permit Uses in an R-l District. <br /> <br />(1) Colleges, libraries, museums, schools, churches and similar public uses provided that no <br />structure shall be nearer than thirty feet to any R-l or R-2 lot line. <br /> <br />Staff finds this criterion to be met. All existing buildings on the seminary campus, including the <br />two buildings proposed to be used for the school, meet a 30’ setback to all property boundaries <br />(which abut R-1 or R-2 zones). The closest setback for any of the campus buildings to another <br />single family home is 100’. The closest setback from the McMillan Center or Spencer buildings <br />proposed to be used for the school is nearly 250’ to the nearest home. <br /> <br />Beyond the 30’ setback standard in Zoning Code Section 4-030 (1), the special use standards of <br />Section 8-130 must also be considered. Staff provides the following analysis to those criteria <br />(staff responses in italics): <br /> <br />Sec. 8-130. Special Use Standards. <br /> <br />No special use shall be recommended by the Planning Commission unless it shall find: <br /> <br />(1) That the establishment, maintenance, or operations of the special use will not be detrimental <br />to or endanger the public health, safety, morals, comfort or general welfare. <br /> <br />Staff finds this criterion is met. A 300 student, K-8 grade school has impacts somewhat <br />comparable to the existing seminary use in terms of being an institutional/education use. Per the <br />applicant’s narrative, the traffic associated with the school would be less traffic than what the <br />seminary generated during its higher enrollment years. Because of the school’s relatively small <br />size, it is unlikely that much after-school or weekend traffic would be generated. The City
