<br />(4) That adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br /> <br />Staff finds this criterion to be met. Because existing buildings are being utilized, utilities, access <br />roads, drainage and other necessary facilities are already being provided and will be adequate <br />to support the proposed special use. It should be noted the City Engineer finds the existing road <br />system is adequate to support the proposed traffic and the City’s Building Official and Fire <br />Marshal will require any renovations to existing buildings to meet minimum building and fire <br />codes. <br /> <br />(5) That the special use shall in all other respects conform to the applicable regulations of the <br />district in which it is located. <br /> <br />Staff finds this criterion to be met. All setback, structural coverage, hardcover, building height, <br />and parking requirements on site meet or exceed minimum standards. There are no <br />nonconformities present and the site is well maintained. <br /> <br />To conclude, staff finds the special use permit criteria to be met and would recommend approval <br />subject to the conditions discussed. <br /> <br />STAFF RECOMMENDATION <br />Staff recommends approval of the Special Use Permit to allow use of the property at 3000 5th <br />Street NW for a 300 student K-8 school, subject to the following criteria: <br />1. Use of the property for the special use shall be consistent with the submitted Site Plan <br />and conceptual floor plans. <br />2. The maximum number of students allowed shall not exceed 300. <br />3. The school shall be limited to grades kindergarten thru eighth grade. <br />4. Only the McMillan Center and Spencer Library shall be utilized for the proposed school, <br />as outlined in the applicant’s narrative. <br />5. The playground area is limited to the area depicted on the submitted site plan and shall <br />not extend north or east past the existing trail. <br />6. No more than 150 students shall be allowed to utilize the playground space at a given <br />time to minimize noise impacts to neighbors. <br />7. Bus traffic to and from the site shall be limited to the route depicted on the submitted Site <br />Plan, with buses entering from 5th Street NW and exiting to Stinson Boulevard. <br />8. Bus and vehicle trips delivering children to the school and picking them up from school <br />shall be limited to 40 in the morning and 40 in the afternoon. <br />9. School activities (hours of operation) shall be limited to Monday thru Friday from 7am to <br />5pm. Up to five exceptions to these hours shall be permitted per school year for special <br />events, except that special events shall limit outdoor activities as follows: <br />a. Monday thru Friday: No outdoor activities past 8pm <br />b. Saturday: No outdoor activities past 3pm <br />c. Sunday: No outdoor activities allowed <br />Any use of the playground by non-school-affiliated users would not be subject to these <br />hours. <br />10. Permits shall be pulled for all building improvements and all building and fire code <br />standards shall be followed.
