PLANNING REPORT

DATE: May 12, 2017
CASE: PPP17-0001, PPF17-0001, PP17-0001, PPUDF17-0001, PSP17-0001
SUBJECT: Planned Unit Development, Plat, and Site Plan for Development of Block
D in New Brighton Exchange with a 37,000 SF
Office/Testing/Certification Building & Associated Site Improvements
APPLICANT: Dan Mueller of Ryan Companies, Acting on Behalf of TUV SUD,
America Inc. (TUV)

REQUEST & BACKGROUND
The applicant has submitted the following land use applications in support of development of
Block D in New Brighton Exchange with a 37,000 SF office/testing/certification building and
associated site improvements, including surface parking, landscaping, and utilities:
• Preliminary & Final Plat: Converts the existing legal description from an undevelopable
outlot to a lot and block definition. Will also amend the existing physical property
boundaries to meet the needs of the development.
• Preliminary & Final Planned Unit Development: Allows development of the property
under NBE, New Brighton Exchange zoning district regulations, with specified
deviations in connection with enhanced pedestrian and landscaping features.
• Site Plan: Provides an analysis of the proposed plans to ensure compliance with
minimum development standards in the Zoning Code.

The proposed building will be used for office, testing, and certification in support of TUV’s
business-to-business engineering service that provides international safety testing and
certification. TUV has indicated the proposed building would employ 55 persons.

This property is located on the east side of Old Highway 8 NW within the New Brighton
Exchange redevelopment area. The development will occur on property known as Block D,
which consists of approximately four acres of land. This property is directly adjacent to the Old
Miller Dump, where the City implemented a clean-up plan in 2008-2010, and is part of the
former Butcher’s Spur rail line. While this property is not part of the dump and the rail road has
been removed, its proximity to both the dump and former rail line creates the need to secure
approvals from the Minnesota Pollution Control Agency with regard to old railroad debris and
soil gas (methane) migration sub-surface from the dump.

The property is currently vacant and owned by the City of New Brighton. The Economic
Development Commission and City Council have reviewed the general business terms with
regard to TUV’s plans to purchase and develop this parcel. In addition to the land use approvals,
the Council will separately execute a Private Contract for Redevelopment with TUV. The
proposed timetable includes closing on the property in June and starting construction in July.
The estimated build-out schedule (not including the expansion space) is just shy of 12 months.

The Site Plan includes a 12,200 SF expansion space with additional surface parking. This is
included for illustrative purposes only and would require a separate Site Plan and Planned Unit
Development approval prior to construction. The purpose of depicting this on the Site Plan is to
provide the Commission with a broader perspective of how Block D will appear fully developed.
