RESOLUTION <br />PLANNING COMMISSION <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF A <br />PRELIMINARY AND FINAL PLANNED UNIT DEVELOPMENT, PRELIMINARY AND FINAL PLAT <br />TO BE KNOWN AS NEW BRIGHTON EXCHANGE 3RD ADDITION, AND A SITE PLAN. <br /> <br />WHEREAS, an application has been made by Dan Mueller of Ryan Companies (Ryan) <br />acting on behalf of TUV SUD America, Inc. (TUV) to be considered for a Preliminary <br />and Final Planned Unit Development, Preliminary and Final Plat, and Site Plan for <br />development of a 4.19 acre parcel with an approximately 37,000 SF <br />office/testing/certification building within the New Brighton Exchange Redevelopment <br />Area located at the northeast corner of I-694 and Old Highway 8 NW, east of Old <br />Highway 8 NW. <br /> <br />WHEREAS, the procedural history of the applications are as follows: <br />1. Applications for a Preliminary and Final Planned Unit Development, Preliminary and <br />Final Plat, and Site Plan were received on April 21, 2017. <br />2. Public hearing notices for the requests were published in the New Brighton Bulletin <br />on May 3, 2017. <br />3. Public hearing notifications were mailed to all property owners within 600’ of the <br />subject property on May 5, 2017. <br />4. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on May 16, 2017. <br />5. The Planning Commission recommended conditional approval of the requests on May <br />16, 2017. <br /> <br />WHEREAS, the Planning Commission makes the following Findings of Fact with respect to <br />the Preliminary and Final Planned Unit Development (PPP17-0001, PPF17-0001), <br />Preliminary and Final Plat (PP17-0001, PPUDF17-0001) of NEW BRIGHTON <br />EXCHANGE 3RD ADDITION, and Site Plan (PSP17-00012): 1. The property is located on the east side of Old Highway 8 NW within in the New <br />Brighton Exchange redevelopment area, specifically 4.19 acres at the southwest <br />corner of 14th ST NW and Northwest Parkway, also known as Block D of the NWQ <br />Framework Plan. <br />2. The proposed plan includes construction of a office/testing/certification building of <br />approximately 37,000 SF for TUV, including associated surface parking, lighting, <br />landscaping, signage, and other related site improvements. <br />3. The property is zoned NBE, New Brighton Exchange. <br />4. The property is guided in the New Brighton Comprehensive Plan for CC, City Center. <br />5. The applicant has requested Site Plan approval and the Planning Commission has <br />reviewed the Site Plan against all criteria within Chapter 6, Article 6 of the Zoning <br />Code. <br />6. The Planning Commission reviewed all Site Plan criteria and identified regulations <br />that are met and regulations that would be permitted a deviation under the PUD. <br />7. The applicant is proposing Preliminary and Final Planned Unit Development for the <br />entire 4.19 acre site.
