<br /> <br />2 <br /> <br />certification. TUV has indicated the proposed building would employ 55 persons. This property is located on <br />the east side of Old Highway 8 NW within the New Brighton Exchange redevelopment area. The development <br />will occur on property known as Block D, which consists of approximately four acres of land. This property is <br />directly adjacent to the Old Miller Dump, where the City implemented a clean-up plan in 2008-2010, and is part <br />of the former Butcher’s Spur rail line. While this property is not part of the dump and the rail road has been <br />removed, its proximity to both the dump and former rail line creates the need to secure approvals from the <br />Minnesota Pollution Control Agency with regard to old railroad debris and soil gas (methane) migration sub- <br />surface from the dump. <br /> <br />Planning Director Gundlach reported the property is currently vacant and owned by the City of New Brighton. <br />The Economic Development Commission and City Council have reviewed the general business terms with <br />regard to TUV’s plans to purchase and develop this parcel. In addition to the land use approvals, the Council <br />will separately execute a Private Contract for Redevelopment with TUV. The proposed timetable includes <br />closing on the property in June and starting construction in July. The estimated build-out schedule (not <br />including the expansion space) is just shy of 12 months. The Site Plan includes a 12,200 SF expansion space <br />with additional surface parking. This is included for illustrative purposes only and would require a separate Site <br />Plan and Planned Unit Development approval prior to construction. The purpose of depicting this on the Site <br />Plan is to provide the Commission with a broader perspective of how Block D will appear fully developed. <br />Staff recommends approval of the Preliminary and Final Plat of NEW BRIGHTON EXCHANGE 3RD <br />ADDITION, approval of the Preliminary and Final Planned Unit Development, and approval of the proposed <br />Site Plan, subject to the following conditions: <br /> <br />1. The property is developed in accordance with the Site Plan and Exterior Elevations and Perspectives <br />dated 5/9/2017 attached to this report and incorporation of all changes noted herein. All other plans must <br />be updated to reflect the Site Plan depicted on sheet C300 dated 5/9/2017. <br />2. Any changes to the plans will be considered in accordance with Zoning Code Section 7-260 and if <br />considered “major amendments” will be required to be reviewed by the Planning Commission and City <br />Council after holding a public hearing. <br />3. The applicant enters into a Planned Unit Development Declaration and a Subdivision Agreement prior to <br />development of the site. <br />4. Construction must commence by August 1, 2017 (Commencement Date) and the development shall be <br />completed by December 31, 2018 (Compliance Date). <br />5. Incorporation of the recommendations of the Interoffice Engineering Memo dated 5/11/2017 and the <br />Public Safety Memo dated 5/10/2017, both attached to this report. <br />6. The Plat is subject to review and incorporation of the Ramsey County Surveyor’s comments. <br />7. Park dedication fees in the amount of $55,212 are due prior to the City releasing the plat for recording <br />with Ramsey County. <br /> <br />Dan Mueller, Ryan Companies, thanked staff for the thorough staff presentation. He stated he was excited to be <br />working with the City of New Brighton and TUV SUD on this project. <br />Commissioner Danger questioned what type of testing would be conducted at this facility. Mr. Mueller <br />explained TUV SUD completed radio wave testing within large testing chambers. <br />Commissioner Danger asked if any environmental sensitive materials were used in the testing chambers. Mr. <br />Mueller did not believe this to be the case. <br />Commissioner Jones inquired if the expansion space was for testing chambers or office space. Mr. Mueller <br />anticipated there would be office and testing chamber space. <br />Chairperson Nichols-Matkaiti questioned if the expansion space would impact the landscaping plan.
