Shoreland impacts exist. Because a special use permit has been requested, Section 12-320 <br />requires notification to the DNR. No comments have been received; however the ordinance does <br />not require DNR approval, only notification. <br /> <br />Public Safety Comments <br />Police and Fire reviewed the proposed plans and offered no comments. <br /> <br />Public Works/Engineering Comments <br />The City Engineer reviewed the proposed plans and has requested numerous technical revisions <br />and additions to the plans, as outlined in the Interoffice Engineering Memo (attached). <br />Incorporation of these recommendations is noted as a condition of approval. <br /> <br />Staff recommends approval of the Site Plan on the condition the applicant ensures the 15’ <br />western side yard building setback is met, the 50’ OHWL building setback is met, additional <br />landscaping is installed, and the street side of the modular building is upgraded to meet the <br />standard of Section 6-390(12). <br /> <br />SPECIAL USE PERMIT ANALYSIS <br />Outdoor storage currently exists on the property and is a grandfathered use. With the level of <br />improvement/investment into the property by construction of the proposed 3,360 SF office <br />building and supporting improvements, the applicant is seeking a Special Use Permit to allow the <br />existing outdoor storage as a permitted accessory use. The outdoor storage currently exists <br />within the area labeled “Existing Gravel Surface to Remain As-Is” on the Site Plan. <br /> <br />Zoning Code Section 6-140 (4) lists outside storage as an accessory use, subject to compliance <br />with the following (staff responses in italics): <br />A. Outside storage areas shall be screened from adjacent residential property and public <br />rights-of-way by landscaping and/or an opaque fence six to eight feet tall. <br /> <br />Staff finds this criterion to be substantially met (see additional analysis within the <br />Nonconforming Use Section of this report). There are no residential uses nearby or <br />visible. The applicant will install required landscaping in the northern front yard and <br />eastern side yard so as to provide screening from the public rights-of-way of 1st ST SW <br />and 5th AVE SW. The new landscaping, combined with the existing vegetation that will <br />be preserved, should provide adequate screening. <br /> <br />B. Outside storage shall have no adverse effect on adjacent land due to unsightliness, noise, <br />odor, dust, smoke, glare, air pollution, excessive or heavy vehicular traffic, bulk chemical <br />storage, or fire or safety hazards. <br /> <br />Staff finds this criterion to be met. This area of New Brighton is likely the heaviest <br />industrial area in the entire City; with many of the sites having intensive outside storage, <br />truck traffic, and noise. In an effort to control unsightliness, staff is recommending that <br />all trailers stored on the site be property licensed and no junk or inoperable trailers shall <br />be allowed. Additionally, the applicant will be required to control dust and be prevented <br />from storing any bulk chemicals on the property (including within the trailers) or any <br />materials that would generate odors, smoke, glare, air pollution, or fire or safety <br />hazards. <br />
