<br />SPECIAL USE PERMIT CRITERIA <br />Based on the new information gathered since the last Planning Report in April, <br />staff has updated the Special Use Permit standards of Zoning Code Section 8- <br />130 below (staff responses in italics): <br /> <br />(1) That the establishment, maintenance, or operations of the special use will not <br />be detrimental to or endanger the public health, safety, morals, comfort or <br />general welfare. <br /> <br />The proposed retort will not create any offensive odors, emissions or smoke that <br />is detrimental to public health and safety. <br /> <br />(2) That the special use will not be injurious to the use and enjoyment of other <br />property in the immediate vicinity for the purposes already permitted, nor <br />substantially diminish and impair property values within the neighborhood. <br /> <br />Staff finds that the proposed cremation business will not be any more injurious to <br />the use or enjoyment of property than the previous automotive repair and sales <br />use. The applicant intends to remove the overhead doors facing north, which <br />staff finds will have a positive aesthetic impact. The majority of the proposed <br />stack will not be visible and traffic to the property will decrease, also having a <br />positive impact on the area. This property is located within an established <br />industrial area such that this specific use will not have any further negative <br />impacts on property value. <br /> <br />(3) That the establishment of the special use will not impede the normal and <br />orderly development and improvement of the surrounding property for uses <br />permitted in the district. <br /> <br />This property is within an established industrial area. The surrounding area is <br />nearly fully developed, thus the business will not impede orderly development. <br /> <br />(4) That adequate utilities, access roads, drainage and/or necessary facilities <br />have been or are being provided. <br /> <br />All existing utilities and access roads will be adequate. With implementation of <br />the rain gardens on the front yard, drainage conditions will improve on site. <br /> <br />(5) That the special use shall in all other respects conform to the applicable <br />regulations of the district in which it is located. <br /> <br />The proposed business would occupy an existing building that was approved in <br />2006 and found to meet all applicable development regulations. Per the staff <br />recommended conditions of approval, all other applicable regulations will be met. <br />
