<br />Watershed District. The plan may require temporary storage of water to <br />accommodate the initial Minimum Improvements. Redeveloper shall coordinate <br />the design of the storm water pond with City. <br /> <br />Special Services District or <br />Master Association: City and Redeveloper recognize that the Redevelopment Property is an integral <br />part of the New Brighton Exchange ("NBE") project. As such, NBE will likely <br />require more public amenities and services than are typically provided by City. <br />City reserves the right pursuant to State law to establish a Special Services <br />District ("Special District") request Redeveloper to participate in the creation of <br />a Master Association to help maintain the quality of development within the <br />NBE. Redeveloper agrees to cooperate with the City in the establishment of a <br />Special District or a Master Association as it relates to the Redevelopment <br />Property. The parties will delineate these amenities and fees in the <br />Redevelopment Agreement. <br /> <br />Public <br />Improvements: Most public improvements have been installed and are available to serve the <br />Redevelopment Property. However, Redeveloper shall pay for any additional <br />public improvements (not previously installed) required pursuant to local codes <br />and ordinances or repair any existing public improvements to serve the <br />Redevelopment Property, including but not limited to: <br />• Streets (concrete curb and gutter, granular sub-base, gravel base and <br />bituminous pavement) <br />• Street lighting <br />• Sidewalks and trails <br />• Public utilities (water main, sanitary sewer and storm sewer) <br />• Storm water ponds and drainage <br />Redeveloper shall coordinate the construction of the Public Improvements with <br />City. <br /> <br />Site Improvements: Redeveloper shall construct all Site Improvements according to City-approved <br />plans in accordance with City's ordinary and customary requirements: <br />• Sanitary sewer <br />• Water mains and stubs <br />• Storm sewers and storm water system elements <br />• Landscaping <br />• Pedestrian improvements <br />• Grading and import/export of soil <br /> <br />The City agrees to reasonably work with the Redeveloper on extraordinary <br />environmental remediation costs as contemplated herein and as will be <br />delineated in the Redevelopment Agreement. <br /> <br />Effect of Term Sheet: This Term Sheet outlines the terms under which the parties are willing to enter <br />into a Redevelopment Agreement, but does not constitute an offer or acceptance <br />on either party's part. All rights and obligations with respect to the <br />Redevelopment Property shall only be as provided for in a Redevelopment <br />Agreement approved by the City Council. <br /> <br />
