City Planner Gozola explained the property was zoned B-1 which meant churches were <br />allowed as a special use within this zoning district. <br />Commissioner Frush requested additional information regarding the City’s parking requirements. City <br />Planner Gozola reported the City requires one parking space per every three seats in a church. He <br />noted the church currently has 18 parking spaces available, which meant the church could have 54 <br />attendees. He indicated formal parking agreements could be pursued by the applicant to secure <br />additional parking spaces. <br />Commissioner Fynewever asked if the SUP was for the tenant or the land. City Planner Gozola <br />reported the SUP would run with the land. <br />Chairperson Nichols-Matkaiti opened the Public Hearing at 7:26 p.m. <br />Lance Schefer, building owner, explained the parking lot had 57 spaces. He stated he was excited to <br />have a church interested in moving into the basement space. He commented on how the church use <br />would not interfere with the other businesses in this building as they were done with work at 5:00 p.m. <br />This meant the parking lot was wide open in the evening hours. <br />Chairperson Nichols Matkaiti asked if the building owner had any objections to the proposed <br />conditions for approval. Mr. Schefer stated he did not have any concerns. <br />Motion by Commissioner McQuillan, seconded by Commissioner Murphy to close the Public Hearing <br />at 7:32 p.m. <br />Approved 7-0. <br />Motion by Commissioner Frischman, seconded by Commissioner McQuillan, to approve staff <br />recommendation. <br />Approved 7-0. <br />(B) VARIANCE & NONCONFORMING USE PERMIT. Request from Chad Johnson, owner of Big <br />Louie’s restaurant located at 790 County Road D West, to replace a solarium that is legally <br />nonconforming to setbacks with an enclosed room that does not expand the building’s current <br />footprint – PID: 32-30-23-43-0007. <br />City Planner Gozola reported the owner of Big Louie’s Restaurant, Chad Johnson, is seeking approval to <br />convert a legal nonconforming solarium on the eastern side of the b uilding to an enclosed room <br />matching the remainder of the facility. The footprint of the building will not change, but there will <br />technically be an expansion of the building upward within the required 30 -foot setback thereby <br />triggering the need for a variance. Notably, the solarium was previously approved via variance in 1987 <br />for its current location, but a variance is once again triggered due to expansion in an upward direction. <br />Per staff’s analysis in the report, the addition should only have a positive impact on this property and
