That the establishment, maintenance or operations of the special use will not be detrimental to <br />or endanger the public health, safety, morals, comfort, or general welfare. <br />13. That the special use will not be injurious to the use and enjoyment of other property in the <br />immediate vicinity for the purposes already permitted, nor substantially diminish and impair <br />property values within the neighborhood. <br />14. That the establishment ofthe special use will not impede the normal and orderly development <br />and improvement of the surrounding property for uses permitted in the district. <br />15. That adequate utilities, access roads, drainage and/or necessary facilities have been or are being <br />provided. <br />16. That the special use shall in all other respects conform to the applicable regulations of the <br />district in which it is located. <br /> <br />:~ <br />I <br />I <br /> <br />BE IT FURTHER RESOLVED, the application SP-189 is hereby approved subject to the following <br />conditions: <br /> <br />Conformance and adherence to a~l standards for special use as pertains in Section 8-110 and 8~ <br />130 of the New Brighton Zoning Ordinance. <br />provision of a Restoration Bond in an amount to be determined by the City Building Official <br />prior to the issuance of a Fill Pennit. <br />Obtain all necessary approvals from the U.S. Army, The Minnesota Pollution Control Agency, <br />and the Rice Creek Watershed District prior to the issuance of a Fill Permit. <br />City Engineer approval of grading and drainage plans. <br />All fill, capping, and site restoration activity be completed by December 31,2000. <br />All truck traffic generated by the excavation project travel no further south than Highway 96 on <br />Old Highway 8. <br />The applicant agrees to water and sweep the access road from Old Highway 8 to the excavation <br />site once a day or as needed to control dust. <br />The Restoration Bond not be released by the City until representatives of the U.s. Army, Rice <br />Creek Watershed District, and Minnesota Pollution Control Agency have inspected the site and <br />find it to be capped, graded, and restored per approved plans and requirements. <br />A landscape screen for the west property line ofthe landfill site be approved by the City <br />Council within six months after the landfill is capped. <br /> <br />Adopted this 28th day of November, 1995. <br /> <br />ATTEST: <br /> <br />,} z1 <br />,.,.. .
