<br />Yes, I’ve talked with Tim and the City Attorney regarding how to resolve the duplex <br />issue. He maintains no permanent structural changes have been made to the interior <br />of the home that would make it a duplex. Only a locked door exists to separate upper <br />and lower levels, which alone does not constitute permanent structural changes to the <br />interior. This leaves the requirement that no more than four unrelated adults can live <br />in a single family home. Per the City Attorney’s recommendation, Tim has provided an <br />affidavit certifying that he is in compliance with the Zoning Code requirement that no <br />more than four unrelated adults live in the home. Further, we’ve confirmed there is <br />only one electric and water bill, as well as only one address. Based on everything we <br />know, I’m now satisfied this is merely a legal rental (not a duplex). <br /> <br />I’ve already talked with Tim about his tuck under garage. The tuck under is not as large <br />as the upper level. Tim has indicated he will comply with the 1,664 SF total for <br />detached and attached garages. This will be a condition of approval that will be <br />confirmed before we issue a building permit for the new garage. <br /> <br />Staff will present this information to the Commission on March 20th. Staff is <br />maintaining their approval recommendation. If you wish to request landscaping, let me <br />know.
