The applicant may hold one sale event in the spring and one sale event in the fall <br />per calendar year, <br />2. The date of the vehicle sale events must be submitted and approved by City Staff <br />at least 90 days in advance of the event and must be held on a Saturday or <br />Sunday, <br />3. The sales may only be conducted between the hours of 8:00am and 4:30pm, <br />4. No more than 175 vehicles may be displayed for sale, <br />5. Vehicles for sale must be removed from the property no later than 6:30pm on the <br />day of the sale, <br />6. The Director of Public Safety shall review and approve of each sale event and any <br />traffic safety measure deemed necessary by the Director shall be implemented, <br />and <br />7. If at any time the vehicle sale event creates a Public Safety concern and/or the <br />conditions of this Special Use Permit cannot be met, the City Planner will require <br />reconsideration of the Special Use Permit by notification to the applicant and by <br />holding a public hearing with the Planning Commission. <br /> <br /> <br />5 Ayes, 0 Nays. MOTION APPROVED. <br /> <br /> <br /> <br />Public Hearings: ZA2006-007 Zoning Code Amendment Related to Fence <br />Construction on Lots Abutting a DNR-Classified Lake <br /> <br />At the direction of the City Council, a Zoning Code amendment has been proposed that <br />would restrict fence construction within the lake yard of properties abutting a water body. <br />The intention of the ordinance amendment would be to preserve lake views for lakeshore <br />property owners. In an effort to gain as much feedback from affected property owners, <br />the City notified all property owners who abut a DNR-classified lake, which includes <br />Long Lake, Rush Lake, Pike Lake, Jones Lake, and Poplar Lake. The notice was mailed <br />to 225 property owners. <br /> <br />This amendment would only apply to fences erected on residentially zoned property. The <br />amendment proposes establishment of an “average lakeshore setback” and prohibits <br />construction of a fence within this setback area. The average lakeshore setback is defined <br />as the average distance from the shoreline of existing principal residence buildings on <br />adjacent lots.
