PLANNING REPORT <br /> <br />DATE: April 17, 2018 <br />CASE: PSR18-001 & PNC18-002 <br />SUBJECT: Special Use Permit and Nonconforming Use Permit to Allow Construction <br />of a Detached Garage in Excess of 624 Square Feet at 1196 Rockstone <br />Lane <br />APPLICANT: Cory Hanscom (property owner) <br /> <br />REQUEST & BACKGROUND <br />The applicant is requesting consideration of a Special Use Permit to allow construction of a new <br />detached garage in excess of 624 SF at 1196 Rockstone Lane. Ramsey County tax records show <br />the property currently contains a single family home with a 763 SF attached garage. The <br />applicant proposes to demolish three existing sheds prior to constructing the proposed detached <br />garage. Two of the three sheds are located along Rockstone Court are currently nonconforming, <br />as sheds must be located behind the home. The proposed detached garage will be 22’ x 36’ or <br />792 SF. All setbacks and accessory structure requirements of Chapter 4 of the Zoning Code for <br />the proposed detached garage are met. <br /> <br />In addition to the Special Use Permit, the applicant is also requesting a Nonconforming Use <br />Permit because a 30’ front yard setback is required for an R-1 zoned property, yet the existing <br />home and attached garage are located less than 30’ from the front property line. The applicant <br />has submitted a survey showing the location of the existing home and garage to be 28.9 feet from <br />the front property line. The nonconforming front yard setback of the home will not be increased <br />because the proposed detached garage will not enlarge the overall principal building footprint. <br />Overall nonconformities on the property will be reduced because two front yard sheds will be <br />removed.
