1 <br />RESOLUTION <br />PLANNING COMMISSION <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF A SPECIAL USE <br />PERMIT AND VARIANCE. <br /> <br />WHEREAS, an application has been made by Mounds View Public Schools to permit <br />reconstruction of the surface parking lot at Highview Middle School, 2300 7th Street NW, and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for a Special Use Permit was received on March 23, 2018. <br />2. A public hearing notice for the Special Use Permit request was published in the April 4th <br />edition of the New Brighton Bulletin. <br />3. Public hearing notices were mailed to property owners within 350’ of the applicant’s <br />property on April 6, 2018. <br />4. A letter was mailed on April 11, 2018 notifying the applicant additional time would be <br />needed to process the request and that a Variance would also be required. <br />5. The Planning Commission held a public hearing on the Special Use Permit on April 17, <br />2018, but tabled action to May 15, 2018. <br />6. An application for a Variance was received on April 27, 2018. <br />7. A public hearing notice for the Special Use Permit and Variance were published in the May <br />2, 2018 edition of the New Brighton Bulletin. <br />8. Public hearing notices were mailed to property owners within 350’ on April 30, 2018. <br />9. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on May 15, 2018 where all interested parties were heard. <br />10. The Planning Commission recommended approval of the Special Use Permit and Varaince, <br />subject to conditions. <br /> <br />WHEREAS, the Planning Commission makes the following Findings of Fact with respect to the <br />Special Use Permit (PSR18-0002) and Variance (PZL18-0004): <br />1. The property is located at 2300 7th Street NW. <br />2. The property is zoned R-1, Single Family Residential. <br />3. The property is guided in the Comprehensive Plan for P-QP, Public/Quasi Public. <br />4. The property is legally described on attached Exhibit A. <br />5. The applicant proposes to reconstruct the surface parking lot at Highview Middle School, <br />requiring a Special Use Permit and Variance. <br />6. The Planning Commission considered the proposed Special Use Permit in accordance with <br />Zoning Code Section 4-030 (1), which requires all specially permitted structures to meet a <br />30’ setback from any R-1 or R-2 lot line. <br />7. A Variance is necessary to approve a 17.4’ setback to the western side lot line, abutting an R- <br />1 property, when normally a 30’ setback would be required. <br />8. The Planning Commission reviewed the proposal in accordance with the following Special <br />Use Permit conditions of Zoning Code Section 8-130:
