1 <br />RESOLUTION <br />PLANNING COMMISSION <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF A SPECIAL USE <br />PERMIT. <br /> <br />WHEREAS, an application has been made by Mounds View Public School to permit construction of <br />a 3,022 SF classroom addition at Pike Lake Education Center, 2101 14th ST NW, and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for a Special Use Permit was received on June 19, 2018. <br />2. A public hearing notice was published in the New Brighton Bulletin on July 4, 2018. <br />3. Public hearing notices were mailed to property owners within 350’ of the applicant’s <br />property on July 3, 2018. <br />4. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on July 17, 2018 where all interested parties were heard. <br />5. The Planning Commission recommended approval on July 17, 2018. <br /> <br />WHEREAS, the Planning Commission makes the following Findings of Fact with respect to the <br />Special Use Permit (PSR18-0001): <br />1. The property is zoned R – 1, Single Family Residential. <br />2. The property address is 2101 14th Street NW. <br />3. The property is guided in the Comprehensive Plan for P-QP, Public/Quasi Public. <br />4. The property is legally described as follows: <br />The Northeast Quarter (NE ¼) of the Northwest Quarter (NW ¼) of the Southeast <br />Quarter (SE ¼) of Section nineteen (19), Township thirty (30), Range twenty-three (23), <br />Ramsey County, Minnesota; Together with that part of Sunbow Lane as dedicated in the <br />plat of Pike Lake Terrace Plat 2, vacated, lying north of the westerly extension of the <br />south line of Lot 6, Block 9, said Pike Lake Terrace Plat 2, and Westerly of a line drawn <br />from a point on the westerly extension of the north line of Lot 6, Block 9, said Pike Lake <br />Terrace Plat 2, distance 18.3 feet west of the northwest corner of said Lot 6 to a point on <br />the westerly extension of the south line of said Lot 6 distant 15.7 feet west of the <br />southwest corner of said Lot 6. <br />5. The applicant’s proposed project consists of a 3,022 SF addition that will accommodate two <br />classrooms at Pike Lake Education Center, and associated sidewalk/trail improvements <br />immediately adjacent to the proposed addition. <br />6. City Zoning Code Section 5-030 (1) requires a Special Use Permit for schools, provided no <br />structure is nearer than 30’ to any R-1 or R-2 lot line. <br />7. The Planning Commission reviewed the proposal in accordance with the following Special <br />Use Permit conditions of Zoning Code Section 8-130: <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare.
