Special Use Permit – 875 3rd Avenue NW
Planning Commission Report; 9-18-18

Page 3
Notable Code
Definitions:
Garage, Private. A building used primarily for the storage or care of large motor
vehicles including but not limited to automobiles, pickup trucks, and campers.
Yard, Side. A yard which is not included in a rear yard or in a front yard.

Applicable
Codes:
Chapter 5, Article 7, Section 4-530 Accesory Buildings in Residential
Districts.
Sub (1)(B): Requires accessory buildings to complement the existing primary
structure in height and materials, and conform to all setback requirements.
Sub (1)(D): Limits detached garages to 1,064 square feet, and requires an SUP
for garages larger than 624 sq ft.
Sub (1)(E): Establishes special SUP criteria for garages in excess of 624 sq ft.
Chapter 8, Article 2, Special Use Permit and Variance.
Identifies the process by which a special use request is to be reviewed and
decided.

Applicant’s
Narrative:
Dear Mayor and Council Members,
Our family has been a resident of New Brighton for the past 26 years. We are finally at a point
where we can improve our property and would appreciate your consideration for a 26 x 30, 3 stall
garage.
Sincerely,
Karen & Joel Werronen

Special Use Permit Review
In General: The need for a Special Use Permit is triggered by the size of the garage. All
accessory structures in a residential zone in excess of 624 square feet require
approval of a special use permit.

Measurements:

Provided an SUP is approved for the proposed building size, construction as
proposed would eliminate the existing legal nonconforming building in favor a
new garage meeting all setback requirements.
Setback Comparison

Front
Yard
Interior
Side (N)
Interior
Side (S)
Rear
Yard
Required 30 feet 5 feet 30 feet 5 feet
Current Garage 98’ 33’ 24’ 4’
NEW Garage 94’ 26’ 24’ 6’
