1 <br />RESOLUTION <br />CITY COUNCIL <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT <br />AND NONCONFORMING USE PERMIT TO AUTHORIZE A CHURCH TO OPERATE <br />WITHIN THE LOWER LEVEL OF THE EXISTING OFFICE BUILDING AT <br />2722 HIGHWAY 694 SERVICE DRIVE <br /> <br /> <br />WHEREAS, the City of New Brighton is a municipal corporation, organized and existing under the <br />laws of the State of Minnesota; and, <br /> <br />WHEREAS, the City Council of the City of the New Brighton has adopted a comprehensive plan <br />and corresponding zoning regulations to promote orderly development and utilization of land within <br />the city; and, <br /> <br />WHEREAS, Troy Axelson and Tina Nyemah (the “Applicants”) made application to the City on <br />10/22/18 for a special use permit to authorize a church to operate within the lower level of the <br />existing office building at 2722 Highway 694 Service Drive, which has the property identification <br />number of 19-30-23-34-0010; and <br /> <br />WHEREAS, the Applicants have also made application to the City on 10/22/18 for a <br />nonconforming use permit to authorize the continuance of a legal nonconforming parking lot that is <br />currently within front, side, and rear yard setbacks; and <br /> <br />WHEREAS, the proposed activities on the site would be limited to small group prayer and bible <br />study on Tuesdays and Fridays from 7:00 p.m. to 8:30 p.m., and Sunday worship services between <br />11:30 a.m. and 1:30 p.m.; and <br /> <br />WHEREAS, the special use permit would authorize the proposed church only within the lower level <br />of the existing building at 2722 Highway 694 Service Drive; and <br /> <br />WHEREAS, the use would have access to a minimum of eighteen (18) parking spaces for <br />employees and parishioners along with additional shared parking made available by other tenants of <br />the building; and <br /> <br />WHEREAS, the proposed use is not necessitating any changes to or expansion of the existing legal <br />nonconforming parking lot; and <br /> <br />WHEREAS, staff fully reviewed the request and prepared a report for consideration by the Planning <br />Commission at their meeting on November 20, 2018; and <br />
