Planning Report <br />Nonconforming Use Variance Review <br /> <br /> <br />To: Planning Commission <br />From: Ben Gozola, Assistant Director DCAD <br />Meeting Date: 11-20-18 <br />Applicants: Chad Johnson <br />Main Contacts: (same) <br />Location: 790 County Road D <br />Zoning: B-3 <br /> <br /> <br />Introductory Information <br />Project: The owner of Big Louie’s Restaurant, Chad Johnson, is seeking approval to convert a <br />legal nonconforming solarium on the eastern side of the building to an enclosed room <br />matching the remainder of the facility. The footprint of the building will not change, <br />but there will technically be an expansion of the building upward within the required <br />30-foot setback thereby triggering the need for a variance. <br /> <br />History: The parcel has been used for restaurant purposes for decades (Big Louie’s, Main <br />Event, Sambo’s, etc). <br /> The solarium was approved to be located within the setback by resolution 87-126. <br />Unfortunately, the proposed expansion upward triggers the need for another <br />variance. <br /> <br />Request(s): The applicant is requesting a 17’ variance from the required 30’ setback from <br />the right-of-way for Highway 88. <br /> Per Section 8-460, review of the requested variance will quality as a <br />“nonconforming use variance” which fulfills review of the nonconformity. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
