2 <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of New Brighton <br />hereby approves the requested special use permit based on the following findings of fact: <br />1. The subject property is guided for public/quasi-public use by the comprehensive plan, and <br />schools are a specially permitted use in the corresponding R-1 zoning district. <br />2. Continued operation of a school at the proposed location will not be detrimental to or <br />endanger the public health, safety, morals, comfort, or general welfare of the community. <br />3. The proposed school improvements will not impact the use and enjoyment of the subject and <br />surrounding properties provided conditions regarding bus routing are adhered to. <br />4. The small additions to the school building will not have detrimental impact on area property <br />values. <br />5. The proposed changes to Bel Air Elementary will have no impact on the subsequent <br />development (or redevelopment) of surrounding property. <br />6. The subject site appears to be adequately served by public utilities, roads, and drainage <br />facilities to accommodate the proposed use; existing services will be examined and repaired <br />by the School District if needed. <br />7. The special use will be in conformance with all underlying zoning district requirements. <br /> <br />BE IT FURTHER RESOLVED, that approval of the special use permit shall be subject to the <br />following conditions: <br />1. The School District shall initiate and complete a process to secure vacations of the remnant <br />pieces of right-of-way for 19th and 20th Streets, and shall dedicate public easements in such <br />areas as deemed necessary during that process. <br />2. Landscaping plans shall be reviewed by the City Forester, and any suggested changes to the <br />planting mix shall be implemented with the future project. <br />3. Engineering comments in the 12/12/18 Engineering Memo shall all be successfully addressed <br />prior to issuance of a building permit. <br />4. If the fire hydrant on the property must be moved to accommodate the proposed plans, it <br />shall be relocated to a placement approved by the Fire Marshal. <br />5. Prior to a building permit being issued, the lighting plan will need to be updated to show <br />conformance with the 0.4 maximum on adjacent residential property. <br />6. Failure to adhere to these conditions of approval shall be grounds for revocation of the <br />special use permit amendment by the City Council. <br /> <br /> <br /> <br /> <br />
