She discussed a letter that was sent to homeowners from <br />the City on behalf of an insurance company that could assist property owners with insuring sewer a nd <br />water lines. <br />VI. Public Hearing <br />(A) SPECIAL USE & NONCONFORMING USE PERMITS. A request from Power of Faith Prayer <br />Ministries to operate a church within an existing office building located at 2722 Highway 694 <br />Service Drive. Existing site parking is legal nonconforming requ iring a nonconforming use <br />permit – PID: 19-30-23-34-0010. <br />City Planner Gozola reported Power of Faith Prayer Ministries is seeking to operate a church within the <br />lower level of the Interstate Office Plaza building at 2722 Highway 694 Service Drive. Small group <br />prayer and bible study would occur on Tuesdays and Fridays from 7:00 p.m. to 8:30 p.m., and Sunday <br />worship service would occur between 11:30 a.m. and 1:30 p.m. Current membership of the ministry is <br />approximately 50. The new church would occupy the lowest building level of approximately 3600 <br />square feet, and would need 23 parking spaces at its noted maximum attendance of 70 members. <br />Staff recommends approval of the Special Use and Nonconforming Use Permits, subject to Findings of <br />Fact and the following conditions: <br />1. The Special Use Permit shall authorize the use of the lower level of 2722 Highway 694 Service <br />Drive as a church; expansion to other portions of the building would require an amendment of <br />the SUP. <br />2. Subject to other to state building code limits that might apply, the maximum proposed occupancy <br />of the church shall be limited by available parking as follows: <br />a. Based on the eighteen (18) parking lot spaces reserved for the lower level’s 3600 square feet, <br />up to 54 attendees may be present at any given service. <br />b. For every three additional service attendees over 54 (or fraction thereof), the Power of Faith <br />ministry shall provide one additional parking space within the parking lot. Evidence of a <br />shared parking agreement with other building tenants shall be provided to the City justifying <br />each proposed increase of three people. <br />c. With property shared parking agreements in place, this SUP shall authorize up to ninety (90) <br />attendees at any given service if a full twelve (12) parking spaces are provided via shared <br />parking arrangements. <br />d. Parking for all church services must be served by the parking lot; street parking shall not <br />count towards needed parking for attendees. <br />3. The applicant or building owner shall successfully address any complaints regarding noise made <br />by a tenant who was actively renting space at the time of SUP issuance, or complaints made by <br />surrounding property owners. <br />4. Failure to adhere to these conditions of approval shall be grounds for revocation of the special <br />use permit by the City Council.
