The City will pay all costs associated with this due diligence, which is <br />estimated at $20,000. <br />• The Purchase Agreement will provide access to the City and its agents to conduct due <br />diligence investigation. <br />• The City will obtain a Title Commitment, paid for by the seller, within 20 days of the <br />effective date of the Purchase Agreement. <br />■ A closing date would be set within 30 business days after the City has satisfied or <br />waived all contingences (noted in the above bullet point). <br />• No broker agents fees are due to any party. <br />• Payment of earnest money in the amount of $22,500 will be due by the City once the <br />Purchase Agreement is signed by both parties. The earnest money will be held at Land <br />Title until closing, at which time the money will be applied towards the purchase price. <br />Mayor Johnson asked why the City owned the vet clinic property. City Manager Lotter stated it was his <br />understanding the property was purchased to allow for film expansion ofthe Public Works Facility, if the <br />need were to arise. Assistant Community Assets and Development/Planning Director Gundlach commented <br />the Public Works Facility was not in need of additional space at this time and noted this parcel was being <br />included in discussions for the proposed Korean Church redevelopment project. <br />Councilmember Burg stated she believed this project would be made better by having this property included <br />in the redevelopment project. <br />Councilmember Jacobsen indicated New Brighton was a fully developed City and the opportunity for <br />redevelopment opportunities were few and far between. He stated he was really excited to see the City <br />working to bring these properties together in order to create a well-planned redevelopment project for the <br />community. <br />Mayor Johnson reported for the record the City had not used eminent domain in order to acquire this property. <br />Les Matefly, property owner, explained this was the case. He indicated he contacted the City upon learning <br />about the sale of the Korean Church in order to see if the City would be interested in purchasing his property <br />as well. <br />Coundi neinlyer Allen commented the purchase of this property would greatly assist in redeveloping the <br />Korean Church property. <br />COLIII I I )Hempr Burg discussed how the proposed redevelopment project would create more tax revenue for <br />the community. <br />4 Ayes, 0 Nays -Motion Carried <br />3. Consider A(Ioption of Ordinance No. 860 and a Resolution regarding Amendments to <br />Chapter 9 ofthe Zoning Code regarding content -based language and billboards and to allow <br />summary publicatiozi in lieu ofthe entire Ordinance. <br />Motion by Councilmember Jacobsen, seconded by Councilmember Burg to adopt Ordinance No. <br />860 and adopt a Resolution approving a summary publication of Ordinance No. 860 in <br />lieu of the entire ordinance. <br />City Manager Lotter indicated Planning Director Gundlach would be presenting this item to the Council. <br />Planning Director Gundlach explained the City of New Brighton is requesting a Zoning Code <br />Amendment, amending Chapter 9 titled Signs. The amendments address the following two <br />areas: <br />■ Content -based language — based on recent Supreme Court cases, any content -related <br />standards must be stricken or revised to remove content -specific language. <br />Page 5 of 8 <br />3.
