May 8, 2018 Page 3 of 5 <br />Public_Hearin2 <br />Consider Adoption of Ordinance No. 861 and a Resolution revising procedural <br />requirements for various land use actions and allowing for a summary publication. <br />Motion by Councilmember Jacobsen, seconded by Councilmember Allen to open the <br />Public Hearing. <br />5 Ayes, 0 Nays - Motion Carried <br />The Public Hearing was opened at 6:47 p.m. <br />City Manager Lotter indicated Assistant Director of Community Assets and DevelopmenvPlanning Director <br />Gundlach would be presenting this item to the Council. <br />Assistant Director of Community Assets and Development/Planning Director Gundlach explained at the <br />advice of the City Attorney, staff is proposing the supermajority voting requirement for special <br />use permits, variances, and rezoning requests be revised to a simple majority based upon the <br />requirements in Minnesota Statutes for statutory cities. One exception would be rezoning <br />requests where a residential property is being rezoned to commercial or industrial where the <br />supermajority requirement remains, which is consistent with State Statute. Imposing a <br />supermajority when State Statutes specify a simple majority subjects the City to legal <br />challenge. She reported the Ordinance would not become effective until after May 16th <br />Mayor Johnson asked for additional comments, there were none. <br />Motion by Councilmember Allen, seconded by Councilmember Dunsworth to close the <br />Public Hearing. <br />5 Ayes, 0 Nays - Motion Carried <br />The Public Hearing was closed at 6:51 p.m. <br />Motion by Councilmember Jacobsen, seconded by Councilmember Allen to Adopt Ordinance No. <br />861 and a Resolution permitting a summary publication. <br />5 Ayes, 0 Nays -Motion Carried <br />Council Business <br />None. <br />Commission Liaison Reports, Announcements and Updates <br />Dean Lotter <br />City Manager Lotter provided the Council with an overview from the recently held Open <br />House meeting and discussed several street mill and overlay projects that would be shuffled <br />around due to bad asphalt.
