He commented further on the G.O. Bonds that would be retired. <br />4 Ayes, 0 Nays -Motion Carried <br />Pu blic Hearfog <br />None. <br />Council Business <br />l.Ordinance 863: <br />a.Consider Approval of Ordinance 863 to update Zoning Code Variance Provisions and <br />Consider Approval of a Resolution authorizing Summary Publication for Ordinance 863. <br />Motion by Councilmember Jacobsen, seconded by Councilmember Burg to adopt Onlinance 863, <br />an Ordinance to update the Definition of "Variance" and associated Variance provisions to be in <br />compliance with Current State Statutes. <br />City Manager Lotter indicated Assistant Director of Community Assets and Development Gozola would be <br />presenting this item to the Council. <br />Assistant Director of Commun ity Assets and Developm ent Gozola explained both staff and the Planning <br />Commission are recommending approval of the amended Ordinance language to update the City's variance <br />regulations. He stated around 2010, a combination of legal decisions and actions by the State <br />Legislature required that all communities within the State of Minnesota update its process to <br />issue variances to zoning provisions. While the City of New Brighton did update its ordinance <br />at the time, it neglected to amend the definition of "variance" within zoning which still <br />references the old "hardship" rules that were in place prior to 2010. This ordinance will correct <br />that ov ersight, and will clarify the present language in code relating to the processing and <br />iss uance of variances.
