<br />~ <br /> <br />;: <br /> <br />RESOLUTION No. 95 - 0 9 5 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN APPLICATION FORA NONCONFORMING USE <br />PERMITNC-lOl. <br /> <br />WHEREAS, an application for a nonconfonning use pennit has been made by Vi Roen to permit <br />subdivision of a residential lot; and . <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for NC-lOl was filed with the City of New Brighton on September 29, 1995. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing on <br />October 17, 1995, and all persons present at the hearing were given an opportunity to be heard. <br />3. The City Council considered NC-lOl at its October 24, 1995, meeting. <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in respect <br />to NC-lOl: <br /> <br />1. The following Type IV nonconformities exist on the property: <br />a. The existing house is setback 28 feet from the front property line. <br />b. The existing shed is setback 1.5 feet from the rear property line. <br />2. The subject site is zoned R-l, Single Family Residential. <br />3. Section 4-040 (c) requires a 30 foot front yard setback and a 5 foot rear yard setback in an R-l <br />district. <br />4. The subject house and shed were built prior to the adoption ofthe above setback standards. <br />5. The proposed lot split could not create any additional setback violations. <br />6. The applicant has reduced the nonconfonnities to the greatest extent practical. <br /> <br />BE IT FURTHER RESOLVED, the application NC-l 01 is hereby approved, subject to the following <br />condition: <br /> <br />1.
