BackS{J:'Ound. <br /> <br />1.01. Section 9-130 of the Co~ requires that billboal"ds be at least 200 feet <br />from any property line in a reslden~ district 01" be buffered in accordance with <br />applicable district requirementa as it the billboard constituted a stNctul'e. <br /> <br />1.02. The City Council has become aware that construction of a b111board is <br />planned less than 200 fe0t from a prOperty lIne in a reside~t1al dlatrict. <br /> <br />1.03. The city Counc1l find& ~t the altel"D&tive of pro'riding such buffering <br />as is normally provided for other penntted structures may not adequately obtain <br />optimum land use, promote health, safety t order, convenience, and pueral welfare, <br />or p1'8aerve property values in resi~ntial districts. <br /> <br />1.04. The City intends to conduct the l1eceasary public hearlng& to consider <br />amending the provisions of its Code relating to buffering for billboards. <br /> <br />1.05. A hear1na on such amendments is hereby sche4uled for November 21, <br />1995 before the New Brighton P1anni~ Commission. <br /> <br />1.06. The City Council find~ that adoption of an interim resolution fa <br />necessary to protect the p1enrung process and the health, safety and welfare of the <br />citizens of the City. : <br /> <br />Section 2. Proh1bit1o~. <br /> <br />During the period that this interim 1'esolution is in effeot, no billboard may be <br />constructed oloser than two hundred (200) feet to any property line in a residential <br />district. . <br /> <br />Durina' the period that this m;tel'im resolution 1a in effect no appUcations tor <br />Uoenaeli or permits for billboards ol~er than two hundred (200) feet to any property <br />Une in a Nsidentfa1 district shall be 1aooepted or prooessed. and no suoh llceuses or <br />permits shall be lsaued. . <br /> <br />Section 3.
