<br />p <br /> <br />:. <br /> <br />:. <br /> <br />RESOLUTION No. 95 - 086 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING THE V ACA TION OF AN ALLEY AND UTILITY EASEMENTS IN <br />THE DOWNTOWN AREA. <br /> <br />WHEREAS, the procedural history ofthe application isas follows: <br /> <br />1. The City of New Brighton represents 100 percent of the property owners involved to vacate the <br />described alley and right-of-ways. <br />2. That the City Council, pursuant to published notices, held a public hearing on the vacation, and all <br />persons present at the hearing were given an opportunity to be heard. <br /> <br />Now, THEREFORE BE IT RESOLVED THE CITY COUNCIL OF nm CITY OF NEW BRIGHTON makes the following <br />Findings of Fact in respect to the proposed vacation: <br /> <br />1. The alley and utility easements to be vacated no longer serve a public purpose. <br />2. There are no public utilities proposed for the easement areas. <br /> <br />BE IT FURTHER RESOLVED, the Council hereby vacated the alley and utility easements legally described as <br />follows: <br /> <br />North Alley Easement: <br /> <br />That part ofthe north-south alley within Block 2, First Addition to New Brighton, Ramsey County, <br />Minnesota, lying between the easterly extension of the north and south lines of Lot 46, said Block 2. <br /> <br />South Alley Easement: <br /> <br />That part ofthe former alley lying between what was formerly Lots 15, 16 and 17, and Lots 40, 41 and 42, <br />Block 2, First Addition to New Brighton, according to the recorded plat thereof, which lots and part of said <br />alley have been heretofore vacated, said land being located in the Northwest Quarter of the Northeast <br />Quarter of Section 29, Township 30, Range 23. Also the east 14.00 feet of Lot 10, Block 2, First Addition to <br />New Brighton. The above descriptions vacates easements described in document number 1230430. <br /> <br />Utility Easement: <br /> <br />A strip of land Fourteen (14) feet wide and Forty (40) feet long running North and South, and lying East of <br />and adjoining the East line of what was formerly Lot Forty-five (45), Block Two (2), First Addition to New <br />Brighton, according to the plat thereof on file and of record in the office of Register of Deeds in and for said <br />County, said strip of land being a part of the former alley in said block, which lot and alley have been <br />heretofore vacated, said land being located in the Southwest Quarter (SW Yo) of the Southeast Quarter (SE <br />V. ), Section 20, Township 30, Range 23.
