RESOLUTION No. 95 - 086 STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON RESOLUTION MAKING FINDINGS OF FACT AND APPROVING THE V ACA TION OF AN ALLEY AND UTILITY EASEMENTS IN THE DOWNTOWN AREA. WHEREAS, the procedural history ofthe application isas follows: 1. The City of New Brighton represents 100 percent of the property owners involved to vacate the described alley and right-of-ways. 2. That the City Council, pursuant to published notices, held a public hearing on the vacation, and all persons present at the hearing were given an opportunity to be heard. Now, THEREFORE BE IT RESOLVED THE CITY COUNCIL OF nm CITY OF NEW BRIGHTON makes the following Findings of Fact in respect to the proposed vacation: 1. The alley and utility easements to be vacated no longer serve a public purpose. 2. There are no public utilities proposed for the easement areas. BE IT FURTHER RESOLVED, the Council hereby vacated the alley and utility easements legally described as follows: North Alley Easement: That part ofthe north-south alley within Block 2, First Addition to New Brighton, Ramsey County, Minnesota, lying between the easterly extension of the north and south lines of Lot 46, said Block 2. South Alley Easement: That part ofthe former alley lying between what was formerly Lots 15, 16 and 17, and Lots 40, 41 and 42, Block 2, First Addition to New Brighton, according to the recorded plat thereof, which lots and part of said alley have been heretofore vacated, said land being located in the Northwest Quarter of the Northeast Quarter of Section 29, Township 30, Range 23. Also the east 14.00 feet of Lot 10, Block 2, First Addition to New Brighton. The above descriptions vacates easements described in document number 1230430. Utility Easement: A strip of land Fourteen (14) feet wide and Forty (40) feet long running North and South, and lying East of and adjoining the East line of what was formerly Lot Forty-five (45), Block Two (2), First Addition to New Brighton, according to the plat thereof on file and of record in the office of Register of Deeds in and for said County, said strip of land being a part of the former alley in said block, which lot and alley have been heretofore vacated, said land being located in the Southwest Quarter (SW Yo) of the Southeast Quarter (SE V. ), Section 20, Township 30, Range 23. The above description vacates easement described in document number 1192274. Adopted this 26th day of September, 1995.
