<br />!: <br /> <br />RESOLUTION No. 95-056 <br /> <br />~ <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING THE V ACATlON OF A PORTION OF THE 6TH <br />AVENUE NW R1GHT-Of'~W^Y IN THE DOWNTOWN AREA. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. 100 percent of the adjacent property owners involved support the vacation of the <br />described right-of-way. <br />2. That the City Council, pursuant to published notices, held a public hearing on the <br />vacation, and all persons present at the hearing were given an opportunity to be heard. <br /> <br />Now, THEREFORE BE IT RESOLVED THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON makes the <br />following Findings of Fact in respect to the proposed vacation: <br /> <br />1. The street and right-of-way to be vacated no longer serves a public purpose; <br />2. There are public utilities proposed for the proposed vacated right-of-way; <br />3. Utility easements would be established over said utilities. <br /> <br />BE IT FURTHER RESOLVE)), the Council hereby vacates the public right-of-way over 6th <br />A venue NW legally described as follows: <br /> <br />That part of 6th A venue NW lying southerly of a line described as follows: Commencing <br />at the southeast corner of Lot 23, Block 2, First Addition to new Brighton, now vacated; <br />thence on an assumed bearing of North 89 degrees 13 minutes 18 seconds west, along the <br />south line of said lot, 195.00 feet; thence north 30 degrees 00 minutes 00 seconds west, <br />62.40 feet to the actual point of beginning; thence on a bearing of west, 88.48 feet and <br />there terminating.
