<br />I.' !I <br /> <br />I, <br /> <br />RESOLUTION No. <br />06-007 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND ApPROVING NC05.05 <br /> <br /> <br />REAS, an application has been made by Kimberly Heiderscheid to be considered <br />Type 4 Non-Conforming Use Permit to allow the front yard encroachment of the <br />family house at 308 7th Street NW; and <br /> <br />W REAS, the procedural history of the application is as follows; <br /> <br />1. An application for a type 4 non-conforming use permits was filed with the <br />City of New Brighton on November 30, 2005. <br />2. On December 20, 2005, the Planning Commission held a public hearing <br />and all present were given an opportunity to be heard; and <br />3. On January 10,2006 the City Council reviewed NC05-05. <br /> <br />REAS, the City Council makes the following Findings of Fact in respect to NC05- <br /> <br /> <br />subject site is zoned R-1A, Single-Family Residential. <br /> <br />proposed use is allowed in the R -1 A zoning district. <br /> <br />future use for the site is low density residential; and the proposed use is consistent <br />New Brighton Comprehensive Plan. <br /> <br />applicant is requesting a Type 4 Non-Conforming Use Permit to construct a new <br />om addition. <br /> <br />ype 4 Non-Conforming Use Permit is required for the City to review the site plan. <br /> <br />ere Type 4 nonconformities are present and are proposed to continue, expansion of <br />isting structure, construction of new structures, or resumption of use after <br />ntinuance of use for six or more months shall be allowed only upon permission of <br />ity Council <br />specified in Section 8-460 (2) of the New Brighton Zoning Ordinance, no Type 4 <br />onforming Use Permit shall be granted unless one or more of the following <br />itions are met ; <br /> <br />a. he total number of nonconformities is reduced. <br />b. he impact of any nonconformity upon adjacent premises is reduced to the greatest <br />pra ical <br />xtent. <br />c. he extent of any nonconformity is reduced where practical. <br /> <br />Doc nt5 <br /> <br />I,! <br />
