<br />- v- <br /> <br />RESOLUTION NO. 95- 038 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN APPLICATION FOR ^ SPECIAL USE PERMIT <br />SP-184. <br /> <br />WHEREAS, an application for a special use permit has been made by New Brighton Care Center <br />to allow for the construction of an addition onto an existing nursing home. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a special use permit, SP.184, was filed with the City of New Brighton <br />on June 30, 1994. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on July 19, 1994, and January 17, 1995, and all persons present at the hearing <br />were given an opportunity to be heard. <br />3. The City Council considered SP-184 at its meeting on May 9, 1995. <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in <br />respect to SP-184: <br /> <br />1. The subject site is zoned B-4, Downtown Business. <br />2. Any construction activity in the B-4 district requires a special use permit. <br />3. New Brighton Care Center is an existing nursing home proposing to construct a 13,000 <br />square foot addition. <br />4. The proposed expansion would not increase the number of residents at the nursing home, <br />but would serve to increase the size of resident rooms, enlarge the dining room, and <br />create office space. <br />5. The proposed expansion would also include the construction of a 42 stall parking lot <br />adjacent to the existing facility that would reduce the need for on-street parking and <br />reduce the impact on surrounding land uses. <br />6. The proposed addition would be designed to compliment the townhouses proposed for the <br />site adjacent to the north. <br />7. The establishment, maintenance, or operations ofthe special use will not be detrimental <br />to or endanger the public health, safety, morals, or comfort of the general public. <br />8. The special use will not be injurious to the use and enjoyment of other property in the <br />immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />9. The establishment of the special use will not impede the normal and orderly development <br />and improvement of the surrounding property for uses permitted in the district. <br />10. Adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br />11. The special use shall, in all other respects, conform to the applicable regulations ofthe <br /> <br />Page 1 of2 <br />
