<br />, . <br /> <br />1\ <br />,I <br />i ~ <br />" <br />p~ <br /> <br />RESOLUTION No. 95-0 UJ 8 <br /> <br />I', <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />l RESOLUTION APPROVING JURISDICTIONAL CHANGE OF 7TH STREET NW FROM <br />SILVER LAKE ROAD TO 8TH AVENUE NW. <br /> <br />WHEREAS, the 1991 Minnesota Legislature established a Ramsey County Local Govemment <br />Services Study Commission to "report on the advantages and disadvantages of sharing, cooperating, <br />restructuring, or consolidating..." activities in areas of public service including the transfer of local <br />and State Aid roadways between the County and municipalities; and <br /> <br />WHEREAS, the consolidation plan provides for reclassification of roadways and <br />corresponding changes in jurisdiction including the transfer of local and State Aid roadways between <br />the County and municipalities; and <br /> <br />WHEREAS, 7th Street NW (County Road 96) from Silver Lake Road to 8th Avenue NW <br />located in the City of New Brighton, is presently under the jurisdiction of Ramsey County as a <br />county Road; and <br /> <br />WHEREAS, this roadway segment has been determined to serve a local function only; and <br /> <br />'; WHEREAS, revocation of "County Road" status may be accomplished by resolution of the <br />Ramsey County Board of Comm issioners pursuant to Minnesota Laws 163.11; and <br /> <br />WHEREAS, the consolidation plan stipulates that Ramsey County shall improve the roadways <br />to acceptable levels prior to transferring jurisdiction over roadway segments from Ramsey County to <br />municipalities, and the Ramsey County Capital Improvement Program provides funding for these <br />improvements; and <br /> <br />WHEREAS, the Ramsey County Public Works Department performed an overlay of this <br />segment of 7th Street NW in 1990; and <br /> <br />WHEREAS, this segment of 7th street NW has been improved by Ramsey County to an <br />acceptable level prior to the transfer of roadway jurisdiction as calculated from the Pavement <br />Management System [(90~Condition Rating)/Condition Rating] * 1993 Condition Rating), therefore <br />exempting Ramsey County from providing any compensation from the County Roadway <br />Consolidation Fund to the City of New Brighton for this jurisdictional transfer, <br /> <br />NOW, THEREFORE, BE IT RESOLVED. the City of New Brighton does hereby concur with <br />Ramsey County revoking the "County Road" status of 7th Street NW between Silver Lake Road and <br />8th Avenue NW, and transferring jurisdiction over the roadway to the City of New Brighton; and <br /> <br />BE IT FURTHER RESOLVED, that the revocation of 7th Street NW will be effective the first <br />day of the second month following the date the County is in receipt of an adopted resolution from the <br />City of New Brighton concurring with the County revoking the "County Road" status of 7th Street <br /> <br />Page 1 of2 <br />
