<br />., <br /> <br />RESOLUTION No. 95- 027 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />! RESOLUTION DENYING SUBDIVISION OF CERTAIN PROPERTY WITHIN THE CITY OF NEW <br />BRIGHTON (generally 100 I-I 021 1 st Street NW). <br /> <br />WHEREAS, the City of New Brighton has been requested to subdivide certain property within the City of <br />New Brighton described as follows: <br /> <br />That part of the South Half of the South Half of the Southeast Quarter of the Southwest Quarter, <br />lying east of the west 530.68 feet thereof and west of State Highway No.8, Section 29, Township <br />30, Range 23. <br /> <br />That part of the west 530.68 feet of the South Half of the South Half of the Southeast Quarter of <br />the Southwest Quarter of Section 29, Township 30, Range 23, lying south of the center line of <br />County Road E. <br /> <br />WHEREAS, the State Statutes require that if such property is located in municipalities that have adopted a <br />platting ordinance, approval of the municipality must be obtained before such subdivision can be filed; and <br /> <br />WHEREAS, Section 26-1 of the New Brighton City Code provides for the subdivision of property if <br />certain criteria can be met; and <br /> <br />WHEREAS, the Council has determined that such criteria has not been met. <br /> <br />NOW, THEREFORE BE IT RESOLVED THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON denies subdivision <br />of the above described property based on the following Findings of Fact: <br /> <br />I. The subject site has such nonconformities as; a lack of a paved outdoor storage area, the outdoor storage area <br />far exceeds 20% of the total building area on site, the appearance of the buildings and grounds are not in <br />: . harmony with surrounding land uses, and as a result, the subject site has an adverse effect on adjacent property. <br /> <br />. , 2. The proposed minor subdivision would separate the occupied portion of the site from the vacant portion of <br />the site, thus intensifying the nonconforming use of the site and diminishing the existing open area which <br />buffers the occupied portion of the site, and would increase the'impact of all nonconformities on surrounding <br />properties. <br /> <br />3. Separating the vacant area from the occupied area of the site, as proposed, would allow a permitted use in <br />the 1-3 district to be located adjacent to a non-conforming use. <br /> <br />4. The intent of the City's Nonconforming Use standards is to discourage the continuation or survival of <br />.' nonconforming uses on any site and to decrease the impact of such uses on surrounding properties. <br /> <br />NOW, THEREFORE BE IT RESOLVED THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON denies PL-215: <br /> <br />Adopted this 25th day of April, 1995. <br />ATTEST: <br /> <br />~---,.-,//~ ..1/.'. 1:.<)/' ... ~.- L<' <br />- .
