Report from City Council Liaison <br />Mayor Johnson provided the Commission with an update from the City Council. She explained the <br />Council was moving forward with the 2019 Street Improvement Project. She reported a TIF District <br />was approved for the Midtown Village project. She noted the demolition of the New Brighton <br />Elementary School had been approved by the Council. She was pleased to report the City had <br />received an AA+ rating from Standard & Poor’s. She commented on an incident where a young man <br />was saved from drowning and commended the Public Safety Department for their ef forts. She <br />encouraged the public to participate in the Beautiful mural project and to visit the Farmer’s Market <br />on a weekly basis at the Community Center. She reported the Stockyard Days parade had been <br />moved to Saturday, August 3rd at 3:00 p.m. <br />Paul Kampa, 1150 6th Street NE, disrupted the meeting and expressed frustration for not being able <br />to voice his concerns in a public forum. Chair Nichols -Matkaiti encouraged the Mr. Kampa to speak <br />with the Mayor after the meeting. <br />VI. Public Hearing <br />1) Special Use Permit: Request from Murlowski Properties, Inc. to amend an existing Special Use <br />Permit and site plan to authorize expansion of an existing sound mitigation wall and <br />redistribution of previously approved rubble pile storage behind the proposed wall exten sion <br />at 2200 Old Highway 8 – PID 17-30-23-42-0004, PID 17-30-23-42-0008, PID 17-30-23-42-0009. <br />Assistant Director of Community Assets and Development Gozola reported Murlowski Properties <br />Inc is seeking to amend their existing SUP for the property at 2200 Old Highway 8. No new <br />activities are proposed, but the applicants are seeking permission to extend their existing sound <br />mitigation berm/wall south to allow for relocation of previously approved rubble piles further <br />south behind the new wall. Further clarified, the existing approved 4-acre storage site would be <br />relocated to a new 4-acre storage site, and no expansion of overall storage area is proposed. Staff <br />provided further comment on the request and recommended approval of the Special Use Permit, <br />based on the findings of fact and subject to the following conditions: <br /> <br />1. All previous conditions of approval for SUP’s on this site, unless specifically changed by this <br />SUP amendment, shall remain in effect as part of this amendment. <br />2. Uses on the site shall be consistent with all plans approved as part of this special use permit <br />amendment except as required to be updated by City Staff to conform with conditions of <br />approval. <br />3. Approval shall not take effect until the applicant provides the following: a. Evidence from <br />properly licensed individuals that impacts of surcharging the landfill in the proposed rubble <br />pile location will not impact surrounding lands. b. A letter of support from MN Commercial RR <br />indicating that the proposed changes do not affect the ir ability to operate the RR under <br />existing Federal rules/guidelines. c. Approval of the sound wall design by a structural <br />engineer.
