Variance Standards: Side Yard Setback <br /> SIDE YARD BUILDING SETBACK VARIANCE. <br /> A variance cannot be approved unless the Planning Commission and City Council find <br /> that the following standards have been met. Please provide a response as to how/why <br /> your project will meet these criteria. Use additional sheets if necessary and consult with the <br /> Planning Director at your Pre-Application Meeting if you need clarification on the intent of <br /> any of the below standards. <br /> 1. Practical difficulties <br /> We are increasing the occupancy within the R3B High Density Residential Standards and <br /> are needing to encroach our building footprint on the required Side Yard Street setback <br /> of 30'. <br /> 2. Reasonable use <br /> There are 2 side yard setbacks and the one in question fronts along the existing Interstate <br /> 94 Service Dr. <br /> Applying to property <br /> NEW IL/AL/MC BUILDING: The building footprint is shifted into the setback to allow enough <br /> area for an appropriate entry/ drop off area within the site. <br /> SNF ADDITION: Due to State Department of Health requirements, we request a variance <br /> for the skilled nursing home addition. The existing setback fronting the 1-694 service road is <br /> 30'. We propose a setback of 14'-6". <br /> 3. Character of the locality <br /> This setback encroachment does not infringe on residential or business use. Nor would it <br /> be detrimental to the adjoining properties. The adjoining street is the service drive along <br /> Interstate 94. <br /> 4.
