Variance Standards: Side Yard Setback
SIDE YARD BUILDING SETBACK VARIANCE.
A variance cannot be approved unless the Planning Commission and City Council find
that the following standards have been met. Please provide a response as to how/why
your project will meet these criteria. Use additional sheets if necessary and consult with the
Planning Director at your Pre-Application Meeting if you need clarification on the intent of
any of the below standards.
1. Practical difficulties
We are increasing the occupancy within the R3B High Density Residential Standards and
are needing to encroach our building footprint on the required Side Yard Street setback
of 30'.
2. Reasonable use
There are 2 side yard setbacks and the one in question fronts along the existing Interstate
94 Service Dr.
Applying to property
NEW IL/AL/MC BUILDING: The building footprint is shifted into the setback to allow enough
area for an appropriate entry/ drop off area within the site.
SNF ADDITION: Due to State Department of Health requirements, we request a variance
for the skilled nursing home addition. The existing setback fronting the 1-694 service road is
30'. We propose a setback of 14'-6".
3. Character of the locality
This setback encroachment does not infringe on residential or business use. Nor would it
be detrimental to the adjoining properties. The adjoining street is the service drive along
Interstate 94.
4. Consistency with Comprehensive Plan
This intended variance is in compliance with the density requirements of the R-3B
standard.
30 LAND USE APPLICATION: 1101 BLACK OAK DRIVE, NEW BRIGHTON, MN 55112 FEBRUARY 14,2020
