6. ADDITIONAL WRITTEN ITEMS
Variance Standards: Parking Setback
(approved by the City 2/7/19; we request re-confirmation)
FRONT YARD PARKING SETBACK VARIANCE.
A variance cannot be approved unless the Planning Commission and City Council find
that the following standards have been met. Please provide a response as to how/why
your project will meet these criteria. Use additional sheets if necessary and consult with the
Planning Director at your Pre-Application Meeting if you need clarification on the intent of
any of the below standards.
1. Practical difficulties
We would like to increase the on-site parking at the existing front entrance off Black Oak
Drive to relieve on-street parking congestion.
2. Reasonable use
Diagonal parking can be provided but will encroach in the front yard setback. We are
requesting a 5' setback in lieu of 30' per the existing code.
3. Applying to property
In conjunction with the new main entry at the upper level, this will relieve the on-street
parking concern for the residences around the property especially along Black Oak Dr.
4. Character of the locality
The parking will be screened and fenced to prevent headlight intrusion on the R-3B High
Density Residential neighborhood to the west.
5. Consistency with Comprehensive Plan
This will further comply with the parking and density requirements of the R-3B standard.
FEBRUARY 14,2020 LAND USE APPLICATION: 1101 BLACK OAK DRIVE, NEW BRIGHTON, MN 55112 29
